- - all real estate in Yorks. (late estate of Geo. Prickett of London,
merchant), to nephew Ric. Elcock Esq., of York for life, then to
eldest s. of Ric., Thos. for life (provisions throughout for
preservation of contingent redrs.), then son(s) of T. Elcock, in
default etc. to 2nd. s. of Ric., Wm. & son(s), in default to other
sons of Ric., in default to nephew Chas. Weddell of Waddow for life
& s. Thos. for life and Thos.' sons, in default to other sons of
Chas. & Frances Weddell, in default to Thos. Metcalf Esq., of
Nappa, Yorks. for life & his son(s), in default to Sir Thos.
Robinson K.B. (s. of Sir Wm. Robinson of Newby, Bt., decd.), then
to Thos. Robinson, s. of Sir T. Robinson, then to T. Robinson's
sons. Trustees to receive rents if any of above are under age and
apply to education. Jointures can be made at rate of 10% of portion
Rec. leases e.g. of tithes of Huntinton, Earswick, and Towthorp
held from Vicars Choral of York for 3 lives to 3 trustees on trust
to allow those entitled under will to receive rents, and to see to
renewal of leases if necessary. Rec. on marr. of neph. Ric. Elcock
with Barbara Thomlinson, testator made a Settlement (14 January
1714) of 10,000 to purchase lands for neph. & niece. Purchase not
made. 10,000 secured by 2 mortgage terms of 500 and 1000 yrs.
on estate at Wigglesworth and Little Newton in Craven (bought of
Jn. Harding Esq.) These by Assignment of 4 February, 1726 ass. by
Robt. Holden and Robt. Moreton to late Sir Wm. Robinson and Thos.
Metcalf on trusts of Marr. Settlement. Estate at Wigglesworth and
Little Newton to above 3 trustees for same uses as 10,000 and
lands to be purchased therewith subject to limitations of Marr.
Settlement. 2 mortgage terms to be assigned to attend inheritance.
All who come into possession of above estate (except at W'worth &
Little Newton) to adopt surname of Weddell.
- - to sisters Eliz. & My. Weddell and niece My. Thomlinson, annuities
of 200 each for life.
- - To niece My. James annuity of 100 for life
- - To niece Barbara Elcock if she is left a widow annuity of 200 for
life
- - To niece Margaret Elcock (dtr. of above & Ric. Elcock) after dec.
of her f., annuity of 200 p.a. until marriage. Whilst under age
to be used by B. Elcock for her education.
- - To Thos. Weddell, s. of neph. Chas. Weddell & w. Frances, annuity
of 100 (for education during his minority.)
-- To My., Jas., Frances and Jn. Siddall, four youngest children of
niece My. Siddall & Thos. Siddall of York, 200 each when of age or
when they marry.
- - To niece Marg. Elcock 5000 on marriage with parents' consent.
- - To Wm. Elcock, 2nd. s. of R. & B. Elcock 5000 on death of father
(If f. dies before he is 21 to be pd. when he is of age with
interest of 4% p.a. and trustees to use part of legacy during
minority for setting him up in business.)
- - To neph. Chas. Weddell, 2000
- - To Sir Thos. Robinson K.B., 1000 in trust for use of his s. Thos.,
testator's godson.
- - To Thos. Metcalf of Nappa, 500
- - To servant Ben. Brunnell, 100 if in service at time of his dec.
- - To all servants and sister's servant 10 each (if in service.)
- - To three trustees, 500 each.
- - To neph Ric. Elcock 2000, chambers in Greys Inn, saddle horses and
arrears of rent on real estate; interest on stocks, bonds, mortgage
Residue of personal estate to trustees on trust to buy lands for
payment of legacies as directed by Ric. Elcock.
To be buried in Parish Church of Strensall.
