Title
Draft of articles of agreement made 29 March 1743 between
1) John Field, gent, of Hitchin and Sarah his wife
2) Charles Nicholls, gent, of Hitchin
- Recites Charles Nicholls, late father of Mary Field nee Nicholls, bequeathed to Mary 1500 [see Z937/29/3].
- Recites marriage settlement [see Z937/32/1]
- Recites Charles Nicholls [party (2)] did not put out the remaining 1000 into securities but kept it in hand, and Mary is lately deceased leaving issue Thomas Field, John Field and Charles Nicholls Field, all aged 21 and upwards. John Field, party to this writing, had become entitled to one third of the 1000 plus the interest that should have accrued.
- Charles Nicholls, party to this deed, may retain 200, part of the money due to John Field [crossed through are several lines describing a deduction from the third share of 1000 for money John Field owes to Charles Nicholls], the interest to be paid yearly to John. After his death, to be paid to Sarah his wife (if she survive him), and after her death in trust to any living children of theirs, share and share alike, for their maintenance until they attain 21 years, and if no issue survive then to the next of kin of John Field as if he died intestate.
- If Charles Nicholls within 6 months of this date is willing, he may vest the 200 in the purchase of one or more messuages or lands provided he is satisfied with the price of the title, and the property is declared to be to the use of John Field and after his death to the behoof of Sarah, then to trustees to be nominated by Charles Nicholls, and to permit John Field to receive the rents.
- Charles Nicholls shall not be answerable or liable in law or equity for any loss or miscarriage of any security on which the 200 is placed out.
- Charles Nicholls may deduct out of the 200 all his costs.
