Reciting:
- marriage settlement of 18 Jun 1825 - (1) Daniel Hankin; (2) George Hankin (now dead); (3) Charlotte Frances Crommelin, spinster; (4) Daniel Hankin, James Wilkinson; Philip Crowe (both last two now dead) - (2) and (3) shortly to be married - (4) to be trustees of (a) 1,500 3% reduced bank annuities; (b) 42,000 Sicca rupees in hands of Colvin Bazett & Company of Calcutta [India]; (c) 6,000 secured by bond of Daniel Hankin; (4) to hold (a)-(b) in trust with profits for sole use of (3), remainder to (2); (4) to hold (c) in trust with profits for use of (2), remainder to (3); (a)-(c) held by (4) with remainder after deaths of (2) and (3) for use of their children;
- death of George Hankin on 21 Jul 1850 leaving (ii) and five other children;
- Colvin Bazet & Company went bankrupt and several sums were received from their estate as dividends from (b) and were invested by trustees in purchase of 1,200/8/2 3% reduced bank annuitiesm making a total of 2,700/8/2 such annuities;
- indenture of 19 Oct 1852 (1) Charlotte Frances Hankin; (2) George Crommelin Hankin in which (1) appointed one sixth of 3% bank reduced annuities to (2);
- George Crommelin Hankin ordered his 450/1/4 3% reduced bank annuities sold out by trustees and proceeds given to him;
- 6,000 secured by bond of Daniel Hankin was paid on 27 May 1853 and was used to buy 3% reduced bank annuities;
- deed poll of Charlotte Frances Hankin of 10 Jul 1858 assigned 1,000 3% reduced bank annuities to George Crommelin Hankin;
- sale of George Crommelin Hankin's 1,000 3% reduced bank annuities and payment to him
Operative Part:
- (i) and (ii) released (iii) from 1,000 3% reduced bank annuities sold on behalf of (ii)
