Reciting:
- marriage settlement of 3 Apr 1799 between (1) Edmund Morris; (2) Richard Parry and Jane Parry; (3) Edward Parry, George Rous, Rev.William Morris, Henry Charles Litchfield; the marriage being between Edmund Morris and Jane Parry; declaring (3) to stand as trustees of sums of 3,000, 5,000 bank stock and 6,000 in 3% consolidated bank annuities for investment, the interest going to (1) annually for his life, remainder to Jane Parry, remainder to their children subject to deeds or will made by (1);
- Edmund Morris married Jane Parry on 15 Apr 1799 at St.Mary's chapel, Walcot [Somerset], their children being Henry Bebb Morris, baptised at Chenies [Buckinghamshire] on 11 Nov 1800, Charles Morris, baptised at Warfield [Berkshire] on 20 Oct 1802 and Hervey Morris, baptised at Chenies on 30 Nov 1803;
- Henry Bebb and Charles Morris were alive and over 21, Hervey Morris having died on 28 Dec 1823 at Rungpore in East Indies;
- Edmund Morris died on 20 Dec 1826 and was buried at Chenies leaving Jane as his widow and that she was still alive;
- Edmund Morris had made no deed or will regarding the combined sums of 14,000;
- George Rous, William Morris and Henry Charles Litchfield were all dead, leaving Edward Parry as sole surviving trustee;
- Appointment of 12 May 1827 between (1) Jane Morris; (2) Edward Parry, Richard Parry the younger, Thomas D'Oyly and Charles Oldfield Bowles in which (2) were appointed trustees of marriage settlement of 3 Apr 1799;
- the trust funds to which (i) was entitled on death of his mother stood respectively at 8,750 bank stock, 6,000 3% consolidated bank annuities and 1,050 new 3% consolidated bank annuities
Operative Part:
- (ii) lent 2,500 at 5% interest to (i) on security of his half share of the trust fund currently standing at 15,800
