(i) W.& E.Simmons Limited of 78 Victoria Road, Surbiton [Surrey];
(ii) Parochial Church Council of Conventional District of St.Luke, Leagrave;
(iii) St.Albans Diocesan Board of Finance
Reciting:
- conveyance of 17 May 1954 from Emily Sarah Little to St.Albans Diocesan Board of Finance land for site of St.Luke's Church;
- conveyance contained restrictive covenants imposed on (iii) for benefit of adjoining land, "the green land" shown on plan;
- conveyance of 14 Mar 1962 from Emily Sarah Little to W.& E.Simmons Limited of "the green land";
- (iii), at request of (ii) have asked (i) to vary certain restrictive covenants
Operative Part:
- land not to be used other than for purposes of building a church and church hall, parsonage and caretaker's house and for Garden of Remembrance, provided that after 50 years (ii) were entitled to use the land freed from restriction of sub-clause;
- no part of land to be used as a burial ground except for scattering or burial of ashes provided no memorials or headstones erected
