  • Title
    Abstract of the title to a piece of land of 2r 15p including 'The Cottage' and now known as 2 Biggleswade Road, Potton (part of which became part of the Potton Estate, as plot 13; later 6 the Ridgeway) from (1867) 1917 The land [see photocopy plan 1]was conveyed on 8 Oct 1917 from Samuel Whitbread of Southill, esq., as tenant for life in possession, of the Whitbread Settled Estate, and his trustees to George Kitchener of Potton, machinist and farmer, as contracted purchaser of the land for £450, who then sold it to sub-purchaser William Huckle of Deepdale in the parish of Potton, marker gardener, who paid the consideration and an additional £100 to GK. It was described as a messuage or dwelling house with the outbuildings, yard, garden and appurtenances belonging, containing in the whole 2r 15p, at Potton, bounded on the N by Station road, the E by the road from Potton to Biggleswade and on the S and W by property of Wells and Winch Ltd., and in the occupation of G.W.Noble. Recitals in the deed derive title back to the Whitbread settlement of 4 Sep 1867; and the deed includes covenants by WH with the purchaser and his successors in title as the owners of the house and premises known as Claremont at Potton to 'keep clean and in good repair and condition and properly trimmed the bank and hedge' belonging to the land conveyed adjoining Station Road; to keep the trees now standing on the land conveyed and thereafter grown on the same adjoining Station Road 'properly trimmed and in good order and condition and shall not cut down or remove the same'; not to accumulate refuse or rubbish upon the land conveyed; and not to erect 'any house building or structure whatsoever' on part of the land conveyed (coloured green on the plan accompanying the conveyance; see plan 1 which is annexed) Whitbread's signature to the 1917 deed was witnessed by his valet J.H.Jones. The land was subsequently conveyed on 16 May 1951 from Vivian Paul Ellis, formerly of 75 Stuart Street Luton, but then of 'The Cottage', 2 Biggleswade Road, Potton, dental surgeon, to Freda Mary Haile of 26 Grove Road, Dunstable, wife of Victor Andrew Haile, for £1850, using the same parcel description as in the 1917 deed except that the property is now described as No.2 Biggleswade Road, Potton and the abuttals were not given. This deed is endorsed with a memoranda of conveyances of subsequent parts of the land, the first being a conveyance dated 4 July 1973 from FMH, then of 'The Cottage', 2 Biggleswade Road, to Hunting Gate Homes Ltd of South Letchworth (Herts.) of part of the land [see plan 2 annexed] in fee but subject to the covenants in the 1917 deed; the second being a conveyance dated 9 May 1979 to Philip John Gale and Valerie Margaret Gale both of 'Sandholme' 6 The Ridgeway Potton of another part of the land conveyed [edged red and blue on plan 3 annexed] in fee and subject to the 1917 covenants. The original of the second memorandum was amongst the bundle of deeds. The consideration was £2000 and the land was described as a parcel of land at the rear of 2 Biggleswade Road [see plan 3 annexed]. The deed included a covenant for the benefit and protection of no.2 Biggleswade Road by the purchasers that the persons deriving title under them will not at any time erect on the land edged blue on the plan any building or other obstruction other than boundary walls or fences along the boundaries of the land so edged. It also included a declaration that the purchasers would erect and forever maintain an interwoven fence 6' high within the boundary of the land conveyed where marked with a 'T' on the plan. The last conveyance in the bundle was dated 25 April 1986 and witnessed the transfer from PJG and VMG, both of 6 The Ridgeway at Potton, acting as trustees for sale, to Roy Edward Gurney and Lynn Elizabeth Gurney, both of 40 Everton Road, Potton, for £76,500, of: (a) parcel of land in Potton with the dwellinghouse and garage erected thereon known as No.6 The Ridgeway, Potton (formerly known as No.13 the Ridgeway, Potton) as conveyed to the vendors in 1975 (see Z894/2 (b) parcel of land as conveyed to the vendors in 1979 above [see plan 3] Parcel (a) was conveyed from Highacre Construction Company Ltd. of 41 High Street, Royston (Herts.) to PJG and VMG in 1975 (see Z894/2).
