reciting death of Charles Austin on 14 April 1842, whose will dated 1 February 1823 is ineffectual to pass legal or trust estate of Mary Hooker vested in him by her will on 15 December 1827
reciting also that (ii) as eldest son of Charles Austin, by virtue of trust for sale under will of Mary Hooker, lately offered the property for sale by auction at which (iv) was highest bidder at sum of £1260.
Is agreed that £400 owing to (i) shall be paid out of purchase money now in consideration of £400 paid by (iv) by direction of (ii) and (iii), to (i) and in consideration of £860 paid by (iv) to (ii) and by direction of (iii) also (i) to intent that mortgage term may be extinguished, surrenders, and (ii) and (iii) release to (iv) consideration of £400 paid to (i) by (iii)
- Cross Keys etc, with frontage to George Street of 20ft 3 inches, lately in occupation of James Hawkes and now of (iv) for ever. (v) to be trustee for him if necessary also for purpose of protecting (iv) from all claims (if any there be) on said messuage, said debt of £400 shall be considered as being still alive and vested in owner for time being of said messuage
