And Whereas Recites mortgage 7 February 1756 (X 631/17) And Whereas Recites part of mortgage 23 February 1756 (see X 631/19) And Whereas under divers conveyances and ultimately by indentures of lease, release and assignment of 6-7 November 1793 (X631/28) And Whereas Thomas Holroyd by his will of 11 December 1809 appointed Robert Gibson and John Northam, with William Gee since deceased, executors. Thomas Holroyd died c1815 without having altered his will so far as the appointment of the executors all of whom proved the will in the Prerogative Court of Canterbury on 7 July 1815. And Whereas William Gee died about 19 October 1828. And Whereas by Wilden Inclosure Act of 51 George III certain lands of James Dyson were exchanged. And Whereas Recites Conveyance (lease and release) 12-14 December 1813 (X631/35) And Whereas Recites assignment of 14 December 1813 and indentures of 30 January 1802 and 4 April 1806 recited in that deed (X631/36). And Whereas James Dyson made his will dated 24 March 1819 devising to William Young Knight, Charles Jones and Henry William Knight (since deceased) Trustees, all that - Manor and farm messuage called Wilden Shrubbery, the farm consisting of 136a occupied by John Hart. The trustees after the decease of the Testators son conveyed it to the children in equal shares And Whereas Testator James Dyson died shortly after the will was made without having attend it and same will proved at the Prerogative Court of Canterbury on 25 August 1819. And Whereas Henry William Knight died about September 1825 And Whereas James Dyson the son married Ann Sophia Armstrong on 2 August 1823. And Whereas there was issue of the marriage namely, Augusta Sophia now wife of Thomas Wilkins, Anne Maria Jane Wife of John Humphery, Laura Armstrong Dyson, Louisa Milbourn wife of Thomas Brereton, and James Armstrong Francis Dyson. And Whereas William Young Knight died in May 1836 having made his will dated 9 January 1835, appointing Richard Roberts, John Yeens Bedford, William Palmer Knight and Thomas John Knight executors who proved the will in the Prerogative Court of Canterbury on 3 August 1836. And Whereas Recites Conveyance (lease and release) 2-3 April 1838 (X631/51) And Whereas Upon the treaty for the said purchase by Thomas Sheepshanks it was agreed that the several terms of 10000 years, 1000 years, 500 years and 1000 years be assigned to Thomas Holroyd by indenture of assignment, 7 November 1793 and also said terms of 1000 years and 1000 years assigned to William Young Knight by indenture of assignment, 14 December 1813, so far as the said several terms concern the hereditaments are comprised in and released by the said indenture of release bearing even date should be assigned to a trustee named by Thomas Sheepshanks. Now this indenture Witnesseth in pursuance of the agreement and in consideration of the premises and of 5s to Robert Gibson, John Northam, John Yeens Bedford, William Palmer Knight and Thomas John Knight paid by Charles Augustus Smith. The parties, 1 and 2, upon the request of parties 4-6 and upon the nomination of Thomas Sheepstanks hath sold to Charles Augustus Smith his heirs and assigns, the hereditaments and premises to be released by the indenture of release comprised in the several terms of 1000 years, 1000 years, 500 years, 1000 years and 1000 years now vested in parties 1-2 for the residue of the terms.
