And whereas by an Act of Parliament, 51 Geo III for enclosing and exonerating from tithes land in Wilden, and by the award of 28 May 1817 the Commissioners awarded to William Morris and his successors, Rectors of Wilden, for all manner of tithes, the several allotments mentioned in the Act. And Whereas Recites lease and release 13/14 December 1813 (X631/35) And Whereas James Dyson by will of 25 March 1819 devised to William Young Knight, Charles James and Henry William Knight (since deceased): - all that his Manor and farm messuage at Wilden commonly called Wilden Shrubbery, which farm consisted of 136a then occupied by John Hart. That they the trustees or the survivor of them should permit his eldest son James Dyson to receive the rents and profits from the Manor and lands. And upon further trust that the Trustees should, after the death of the testators son James Dyson junior and on James Dyson junior's child(ren) attaining 21 years, divide the Manor and property between them. And Whereas the testator died about March 1819 without having altered or revoked his will, passed in the Prerogative Court of Canterbury on or about 25 August 1819 And Whereas William Henry Knight died in September 1825 And Whereas James Dyson junior married Ann Sophia Armstrong on 14 October 1799 and died in August 1833 in the lifetime of Ann Sophia Dyson who is still living And Whereas there were five children of the marriage namely: Augusta Sophia wife of Thomas Wilkins; Anne Maria Jane wife of John Humphery; Laura Amstrong Dyson; Louisa Milbourn wife of Thomas Brereton and James Armstrong Francis Dyson the youngest of the children who attained 21 years in March 1836. And Whereas Recites marriage settlement of Thomas Brereton and Louisa M Dyson, 15 December 1831 (X631/53) And Whereas no conveyance or settlement has been made pursuant to the marriage settlement of the fifth share of Louisa M Brereton from the estate of James Dyson deceased. And Whereas Recites John Humphrey and Ann M J Dyson marriage settlement of 2/4 April 1836 (X631/56) And Whereas no settlement hath been executed before or since of the fifth share of Augusta Sophia Wilkins from the estate of James Dyson deceased. And Whereas under the respective marriage settlements of 15 December 1831 and 4 April 1836, Thomas and Louisa M Brereton and John and Ann Mara Humphrey, and also Laura Armstrong Dyson and James Armstrong Dyson and their trustees, have contracted with Thomas Sheepshanks for the absolute sale of the farm house, land and hereditaments comprised in the indenture of 6/7 November 1793, 15/16 June 1810 and 13/14 December 1813 (except all those part(s) which were awarded to other persons by the Commissioners under the award of 28 May 1817), but including the land given in lieu. And Whereas William Young Knight to whom the legal estate in fee simple comprised in the indenture 7 November 1793 was so limited in use in trust for the testator James Dyson who died 3 May 1836 without having made or published any will and leaving his eldest son and heir William Palmer Knight who agreed to convey the hereditaments to Thomas Sheepshanks Witnesseth conveyance of the property to Thomas Sheepshanks in consideration of £424 paid to each of the following five parties (total purchase money £2120): (3a) Thomas and Augusta Sophia Wilkins (3c) Laura Armstrong Dyson (3e) James A F Dyson (4a-d) John Humphery, William H Pilcher, Matthew Warton, Thomas Leadon at request of (3b) John and Anne J M Humphery (5a-c) The Rev John Brereton, Thomas Wilkins, John Pulley as trustees for (3d) the Rev Thomas Brereton and Lousa M Brereton.
