    Release forming a conveyance from William Bithrey of Carlton, gentleman, executor of the will of Charles Bithrey of Carleton, his late brother (i) and Charles Bithrey of Carleton Fishers, gentleman (ii). Recitals: - Will of Charles Bithrey, deceased, dated 25 Aug 1765, in which he devised to (i) all his lands, tenements, and real estate, and also his goods, chattels and personal estate upon special trust to dispose of the same; the purchase monies to be applied upon the several trusts in the manner mentioned in his will. Operative part: In consideration of £310 paid to (i) by (ii), (i) conveys to (ii) the said full moiety or undivided half part of and in: (a) all that messuage, cottage or tenement with the appurtenances situated in Carleton, previously in the occupation of Thomas Harper and Lewis Goodwin, and afterwards in the occupation of Uriah Bithrey, and now in the occupation of Thomas Hull and Thomas Gostick their undertenants or assigns. (b) all that close or inclosed ground with the appurtenances heretofore divided into four parts and being now in three parts together as in /6 (a) and also lands as in /6 (b). (c) And also all those several pieces and parcels of arable land, ley and meadow ground lying and being dispersed in the common fields, liberties, precincts of Carleton and Chellington (40a. 1.5r. 16ft) late in the occupation of William Bithrey, as described in the annexed terrier as follows, (includes schedule of quantities of land): Slenworth furlong: - one rood and a half. Meadow Ground: Wignoe Meadow: - also one rood and twelve feet in the second Dole and also four feet in the fifth dole together. ...which were devised by Uriah Bithrey (amongst other lands and tenements) to his son Thomas Bithrey, also deceased, the late uncle of Charles Bithrey and (i), who devised the same (with and amongst other lands, tenements and hereditaments and personal estate) to his two nephews to be forever divided equally between them, as tenants in common. Also all hereditaments and appurtenances to the said lands, and also all the estate, right, title and use of (i) in the said one full moiety or undivided half part of the lands as in (a)-(c) late of his brother, Charles Bithrey. Subject to and chargeable together with the other full moiety or undivided half part of the said lands to the payment of several annuities or yearly rents of £10 and £5 to Mary Bithrey, widow, mother of Charles and William Bithrey, during her natural life.
