The conditions of sale derive title as follows:
one undivided moiety in Lots 1-9, from Steward's Copy Admission of Jeremiah Burch Rosher dated 30 April 1847
one undivided moiety in Lots 10-11, from probate of the will of Jeremiah Burch Rosher 21 January 1875, the purchaser to assume that at the time of his death JBR was seized of an unencumbered estate in fee simple
the other undivided moiety in all the Lots, from Indentures of Lease and Release and Covenant to Surrender 23 and 24 March 1840 respectively, the latter between 1) Edward Burch Field 2) Isabella Hamilton and 3) James Hamilton and James Hastie
It is to be assumed that no former owner of the property whose widow is not mentioned in the abstract left any widow entitled to dower.
