Scope and Content
Reciting:
- Grice & Young Ltd. owned a property on the corner of Albion Street and Matthew Street adjoining property of Cyril Squire Durrant;
- Grice & Young Ltd. had recently opened two unglazed window openings measuring 4’ wide, 3’ high and 3’6” from the ground on Cyril Squire Durrant’s side of the property and overlooking his property, Grice & Young admitting that no right or easement of light or air over his property had been acquired or existed;
- Cyril Squire Durrant had screened the window openings but agreed not to further obstruct them
Agreeing:
Cyril Squire Durrant would not erect any buildings to obstruct the light and air of the windows other than the existing screens; Grice & Young Limited would not, without the consent in writing of Cyril Squire Durrant, enlarge the openings or open any more which overlooked his property; on determination of the agreement Grice & Young would block up the windows
