    Depositions of Witnesses QSR1921/1/5/1a(i) (ii) Division of Luton County of Bedford The Examination of Nellie Norman of 5 Norton Road, Limbury And of Emily Hymus, wife of James Hymus of 8 Norton Road, Limbury And of Hilda May Squires wife of Gaston Squires of 7 Norton Road, Limbury And of Harold Wilshire, Police Constable of Limbury Taken on Oath this 18th day of October in the year of our Lord One thousand Nine Hundred and Twenty at Luton in the County of Bedford, before the undersigned, one of His Majesty’s Justices of the Peace for the said Division in the presence and hearing of Arthur Wallace Canderton who was charged this day, before the Court, for that he the said Arthur Wallace Canderton on the thirteenth day of October One Thousand Nine Hundred and Twenty at Limbury, feloniously did break and enter the dwelling house of Arthur Prudden here situate and therein feloniously did steal certain apples of the goods and chattels of the said Arthur Prudden. And this Deponent Nellie Norman on her Oath saith as follows: I am a spinster and live at 5 Norton Road Limbury. I am Housekeeper to Mr Arthur Prudden of the same address I remember Wednesday last October 13th I went into the front room at 5 Norton Road at 7am to draw the blind up which I did. The window was shut but not fastened. I noticed same apples in glass dish on a table near the window. In consequence of something I heard I again went into this room on the same day at 8.15am. I there found the window open, the bottom sash being up and a quantity of apples were missing. These apples belonged to Mr Prudden and were worth eight pence. The apples could have been reached by stretching from outside. QSR1921/1/5/1a (iii) (iv) And the Deponent Emily Hymus on her oath saith as follows: - I am the wife of James Hymus of 8 Norton Road, Limbury. My house is on the opposite side of the road to No 5 Norton Road. I remember last Wednesday October 13th I was looking out of my downstairs front window at about 7.55am when I saw the prisoner standing in Mr. Prudden’s front garden at No. 5 Norton Road looking through the window. I saw him push up the bottom sash of the window into Mr, Prudden front room and put his hand in through the open window and take some apples. I saw him put them in his pocket, he then came out through the gate and hurried down Norton Road, he was still putting apples in his pocket as he came out through the gate. He was wearing blue overalls and carrying something in a white cloth in his hand. He had a cap on. I told Mr Prudden what I had seen. In the middle of the same morning I saw the prisoner coming along Norton Road with a Policeman. Taken before me: at Luton in the County of Bedford this 18th day of October 1920 (signed) Emily Hymus (signed) John Wright Justice of the Peace for the County of Bedford QSR1921/1/5/1a (v) & (vi) And this Deponent Hilda May Squires on her Oath saith as follows: - I am the wife of Gaston Squires at No.7 Norton Road, Limbury. Number 7 is next door to Number 5 Norton Road. I remember last Wednesday October 13th. I was looking out of my front bedroom window at 7.55am when I saw the prisoner coming down Norton Road, he looked round and then went into the garden of No. 5 Norton Road. I saw him put a white parcel down on the garden path. I saw him put his had to the window in the front of Mr Prudden’s house. I next saw him coming out of the garden gate of No. 5 putting apples in his pocket he then hurried down Norton Road. He was wearing a brownish coat with blue overalls. Later on in the same morning I saw prisoner coming up Norton Road with the Policeman Taken before me: at Luton in the County of Bedford this 18th day of October 1920 (signed) Hilda May Squires (signed) John Wright Justice of the Peace for the County of Bedford. QSR1921/1/5/1a & (vii) (viii) (ix) And this Deponent Harold Wilshire on his Oath saith as follows: - I am a Police Constable in the Bedfordshire Constabulary stationed at Limbury On Wednesday 13th October about 9.30am. I received a complaint from Arthur Prudden 5 Norton Road Limbury that a quantity of apples had been taken from a glass dish from the front room of No. 5 Norton Road. I went to the house and a on the garden under the front room window saw a newly made footprint. Window was then shut. I saw a Mrs Hymus and from her obtained a description of a youth that she had seen in the garden at 8am that morning. I made enquiries and a 10.30am I visited the Alliance Iron Foundry Icknield Road where I saw the prisoner at work. I said to him “ I am a Police Constable you answer the description of a youth who was seen in the garden of 5 Norton Road where a quantity of apples had been stolen” I then cautioned him, and he replied “I came down Icknield roadway to work at 10 minutes to 8. I did not come Norton Road way. I can prove I came Icknield Road way as I saw my brother there” I asked him to come to Marsh Road Police house with me he subsequently cried and said “don’t take me to the Police Station. I gave an apple to a boy at the Foundry the others I have eaten myself” I then took him to the Police Station where I cautioned him and charged him with breaking and into the dwellinghouse 5 Norton Road Limbury and stealing a quantity of apples value 8d the property of Arthur Prudden on the 13th October 1920. Prisoner replied “I did not break into the house, I lifted up the window and put my hand through” Taken before me: at Luton in the County of Bedford this 18th day of October 1920 (signed) Harold Wilshire (signed) John Wright Justice of the Peace for the County of Bedford. QSR1921/1/5/1a (x) Statement of Accused: Borough of Luton to Wit: Arthur Wallace Canderton stands charged before the undersigned, one of His Majesty’s Justices of the Peace for the Division of Luton in the County aforesaid , this 18th day of October in the year One thousand Nine Hundred and Twenty for that he, the said Arthur Wallace Canderton on the 13th day of October 1920 at the Division of Luton feloniously did break and enter the dwelling house of Arthur Prudden there situate and therein feloniously did steal certain apples the goods and chattels of the said Arthur Prudden And the said Charge being read to the said Arthur Wallace Canderton and the Witnesses for the Prosecution being severally examined in His presence, the said Arthur Wallace Canderton is now addressed by me as follows: “Having heard the evidence, do you wish to say anything in answer to the charge? You are not obliged to say anything unless you desire to do so; but whatever you say will be taken down in Writing, and may be given in Evidence against you upon your Trial. And you are clearly to understand that you have nothing to hope from any Promise of Favour, and nothing to fear from any Threat, which may have been holden out to you to induce you to make any admission or confession of your guilt, but whatever you shall now say may be given in evidence against you upon your Trial, notwithstanding such promise or Threat”: Whereupon the Defendant saith as follows Saith a follows: "I do not wish to say anything" (signed) Arthur Wallace Canderton Rear of Document Taken before me at the Court House, Luton in the Borough aforesaid on the day and year first above mentioned (signed) John J Wright And immediately after obeying the direction of the 18th Section of the Act Eleventh and Twelfth Victoria, Chapter Forty-Two, I, the said Justice of the Peace, did demand and require of the said Arthur Wallace Canderton whether he desired to call any Witness; and thereupon answer to such demand the said Arthur Wallace Canderton [neither] called or desired to call [any person or persons] as Witnesses].
