    Depostions of Bejamin Belgrove Franklin of Luton, Surveyor, Arthur Crichton Stuart Benning,of Dunstable Solicitor and Rupert Henry Ebenezer Matthews of Dunstable, Solicitors clerk taken & made upon oaths before two of His Majesty's Justices of the Peace acting in & before the Luton Petty Sessional Division within the Parish of Tottenhoe.

  • Scope and Content
    Re; the Turning, Diverting & in part Stopping up a certain Ancient Public Green Highway, 20 feet wide, in the Parish of Tottenhoe and known as the Banbury Knap and Coombe Green highway, viewed 23rd April 1912. Benjamin Franklin a surveyor for 20 years produced a plan marked "A" which shows the Green Highway leading from the Lower End Road to the Main Road at Middle End Tottenhoe through land belonging to Adelbert Wellington Brownlow between points "A" & "B" on the plan which is intended to be diverted & stopped up and also the land over which the proposed new Highway of a width of 30 feet in lieu is intended to be made between points "C" "E" & "F" on the plan. Arthur Benning a solicitor, produced a certified copy of a Resolution marked "B" and passed to Luton Rural District Council Meeting on 25th March 1912 and a copy of the Resolution marks "C" passed to Tottenhoe Parish Council Meeting on 2nd February 1912. He also produced a printed notice marked "D" published by James East the Clerk of Tottenhoe Parish Council and dated 3rd February 1912 , copies of which were posted & published for 2 calendar months from 3rd February to 4th March 1912 in conspicious places in the village of Tottenhoe in accordance with S.13, of the Local Government Act 1894. He also produced a certified copy of a Resolution marked "E" passed by Tottenhoe Parish Council at a meeting on 4th April 1912, a printed notice marked "F" issued by the Surveyor to Luton Rural District Council ,dated 23rd April 1912 was inserted in the Dunstable Gazette on 24th April1912 and the 5th & 12th of May1912, copies of the papers are marked "G", "H", "I", & "K". He also produced a consent marked "L" bearing the date 4th March1912 from Adelbert Willington Brownlow, a consent marked "M" fromTottenhoe Board of Conservators and 2 consents marked "N", and "O" from Adelbert Brownlow and Gertrude Tindell as owners of 5 and 3 stints or rights of passage over the Banbury Knap and Coombe Green highway. Rupert Henry Ebenezer Matthews, clerk to Messrs Benning & Son, Solicitors , on oath says on 23rd April 1912 he affixed prints of the notice marked "F" at the place and at the side of each end of Banbury Knap and Coombe Green Highway where marked "A" and "B" on the plan marked "A", the notices remained there for 4 successsive weeks. on 27th April 1912 he fixed a copy of the same notice to principle door of the parish Church of Tottenhoe, remaining there for 4 weeks.
