'He laid down from fatigue under a hay rick in the parish of Dunstable, having first taken off his shoes, which he put into his hat, together with a knife, a snuff box, some buttons, a comb and some silver, that he placed the hat with it's contents under his head and went to sleep.' When he awoke he found the contents of his hat, with the exception of the snuff box, had been stolen.
He went to the shop of Francis Emmerson on Markyate Street, Caddington, and found that Emmerson's wife had bought the shoes and resold them but she refused to tell him to whom.
A collarmaker at the opposite side of the street told him she had sold the shoes to Thomas Hedges at Flamstead. He found them in Hedges' possession and he agreed to give them up if Emmerson's wife would give him his money back, which she refused to do.
He then went to a magistrate where he said he had purchased the shore from Thomas Sear of Hemel Hempstead and they cost altogether 10s 8d. and he had only worn them two and a half days. Francis Emmerson confessed that he bought them for 4s 6d.
