(i) George, Viscount Torrington
John Wordham & William Ellis, gentlemen, present tenants
(ii) Robert Henley Ongley of Old Warden, esquire
relating to Coney warren in Old Warden & Southill called Warden Warren
Ongley is seised of Warden Warren
Torrington & his tenants have a right of common for depasturing cattle at all times of the year so far as Southill parish extends on the warren 'marked and distinguished by the letters S.S.' (? reference to a plan which has not survived)
Ongley proposes to destroy the warren and convert to arable, pasture or woodland, and keep the soil free from rabbits and conies
it is agreed:-
1. Torrington with approval of tenants agrees to the suspension of common; to the proposed change of use of the land; and to Ongley's right to the soil;
2. Ongley agrees to use his best endeavours to destroy all rabbits; he will convert the land to arable, pasture or woodland; he will amend all hedges, ditches and fences;
provided that nothing in the above shall invalidate Torrington's claim to common on the Schoolhouse piece near the said warren, about 15 acres, supposed to be the estate of (blank) King esquire, heretofore Sir William Smyth
