Reciting:
- conveyance of 2 May 1906 from (1) John Robert Brown and (2) Francis Henry Humphreys to (3) Arthur Thurlbourn Cook of land on attached plan;
- at his death Arthur Thurlbourn Cook owned other property to SW of that above on which 19 Crescent Rise was built;
- death of Arthur Thurlbourn Cook on 12 March 1955 and proof of his will of 19 September 1951 in PPR on 21 June 1955;
- vesting assent of 7 September 1955 to vest 19 Crescent Rise in Mabel Beatrice Hill;
- conveyance of 7 April 1959 from (1) Mabel Beatrice Hill to (ii);
- doubts had arisen whether the assent of 7 September 1955 was effective to vest the property in Mabel Beatrice Hill as subject to conveyance of 2 May 1906 though such land then formed the curtilage of 19 Crescent Rise
