- Scope and Content(1) Deed of partition dated 8 December 1916 Parties: (i) Ellen Louisa Smith of Clifton Lodge, George Street, spinster (ii) Lizzie Jane Smith of the same address, spinster (iii) Minnie Florence Smith of the same address, spinster (iv) Elizabeth Chapman Smith of the same address, spinster (v) Thomas Neville of Castle Street, Luton, builder (vi) John Ryan Leighton of Luton, solicitor's clerk Reciting: (i)-(v) are tenants in common with equal shares of the premises in the first and second schedules and desire to partition the properties in the first schedule amongst (i)-(iv) Operative part: (i)-(v) convey their fifth parts of the property in schedule one to (vi) First schedule of property: (a) eight cottages or tenements in Chapel Street in the occupations of Messrs Cousins, Moult, Parsons, Bligh, Walker, Odell, Judge and Garrett and known as nos. 47-61 Chapel Street (odds), all which were erected upon a portion of land conveyed to the late Robert Smith by an indenture of 6 April 1858 between the Trustees of Ashtons Charity and Thomas Sworder Second Schedule of property (not the subject of this abstract). Habendum: - properties in the first schedule to the uses of (i), (ii), (iii) and (iv) as tenants in common (2) Will of Ellen Louisa Smith, dated 9 November 1909 - appointed her sister Minnie Florence Smith and Thomas Neville as executor and executrix - £200 to her brother William - whole of remaining real estate and personal estate equally amongst her sisters on condition that if any should die leaving a child or children then their portion to pass to them (3) Death of Ellen Louisa Smith, 2 March 1928 (4) Will proved by Thomas Neville, Minnie Florence Smith having renounced probate, 3 September 1928 (5) Will of Lizzie Jane Smith, dated 9 November 1909 - appointed sister Minnie Florence Smith and Thomas Neville as executor and executrix - £200 to her brother William - whole of remaining real estate and personal estate equally amongst her sisters on condition that if any should die leaving a child or children then their portion to pass to them (6) Death of Lizzie Jane Smith, 21 January 1931 (7) Will proved by Thomas Neville, Minnie Florence Smith having renounced probate, 29 April 1931 (8) Will of Minnie Florence Smith, 9 December 1937 - appointed Thomas Neville of The Grange in Hockliffe and Harry James Cox of Cardiff Road, incorporated accountant, executors and trustees - Harold Heward Cooke to replace any of the executors who are unable to perform their duties - remaining real and personal estate to her sister Elizabeth Chapman Smith (9) Death of Minnie Florence Smith, 24 July 1939 (10) Will proved by Thomas Neville and H.J.
