    i) William Adolphus Partridge as in X732/39 (landlord) ii) Anthony Francis Penyston as in X732/29, of Elmhurst, Eaton near Norwich, esquire, a person incapable through mental incapacity of managing his affairs, per the Reverend W T T Drake as in X732/39, the person appointed to exercise certain powers of a Committee of his estate (tenant) Agreements - i) agrees to let to ii) the pieces or parcels of land scheduled viz.: Tingrith Close (pasture) 7 acres 2 roods 25 perches Harlington Close (pasture) 5 acres 1 rood 28 perches Long Close (pasture) 7 acres 3 roods 25 perches Spinney 3 roods 12 perches Reddings (pasture) 5 acres 3 roods 10 perches Total 27 acres 2 roods 20 perches … except and reserving to i) all timber and other trees and all mines and minerals with free access to cut, work and carry away the same; and, to the person(s) seised of or entitled to certain portions of the farm and premises constituting and known as Harlington Wood End Farm and forming part of the Penyston Estate, the exclusive right and liberty during the term to take and use the water from the spring or well situate on the land to be let, and the right and liberty to maintain and use a line of pipes through the said land for the conveyance of water from the said spring to the adjoining hereditaments belonging to the same person(s), and to deepen and improve the said well and to collect the water by underground channels from the adjoining land, and to inspect the conduit and amend, repair and cleanse the well and line(s) of pipes etc. - the tenancy to be from 29 September 1904 annually, until it is either determined at the end of the first or subsequent year by either party giving 6 months notice in writing, at the annual rent of £29 per annum payable half yearly starting 25 March next - ii) agrees (inter alia): : to pay all rates and taxes (except landlord's property tax) : to keep all hedges, fences and gates in good tenantable repair, he being allowed rough timber for repairs within a distance of 4 miles from the premises (but ii) not to be responsible for repair of the shed now standing on the premises which is in a state of disrepair) : not to permit anything on the premises which may contaminate or injuriously affect the spring or well and pipes or the supply of water thereto : to farm the land in accordance with the best custom prevailing in the district and to manure regularly and sufficiently the same either by feeding cake or by spreading farm-yard manure thereon : to preserve all timber, timber-like trees and 'tellers' : not to mow the pastures in 2 successive years : not to break up the pastures sans consent in writing of i) or his agent under a penalty of £50 per annum (and in like proportion for any lesser quantity) : not to cut or lop any timber or 'timber like trees' : after he has received or given notice to quit, not to cart any manure or muck on the land sans giving i) or his agent 6 days notice of his intention to do so : not to assign the premises or any part thereof sans written consent of i) or his agent : that i) shall have ingress and egress for himself and all persons authorised by him to the land, to inspect the state of repair and condition thereof and to cut and remove timber - i) agrees to find rough timber for repairs within 4 miles from the premises - i) and ii) agree that i) shall have a right of re-entry on non-payment of the rent for 21 days whether legally demanded or not or on breach of any of ii)'s agreements witness to signature of i): Georgiana Mary Steel of Elmhurst, Eaton, Norwich, spinster
