Scope and Content
Parties:
(i) John Welch of Battlesden, farmer and dairyman and Sarah his wife (formerly Sarah Gregory, spinster);
(ii) Elizabeth Potts of Eversholt, widow of James Potts of Eversholt, farmer and formerly Elizabeth Gregory, spinster;
(iii) Thomas Purrett of South Court, Linslade [Buckinghamshire], farmer; Elizabeth Purrett of Tebworth, widow;
(iv) Mary Purrett of South Court, spinster;
(v) John Green of Woburn, gentleman;
(vi) James Smith of Eversholt, currier
Reciting:
- marriage settlement of 5 January 1765 between (1) John Gregory the elder and John Gregory the younger; (2) Mary Potts, later wife of John Gregory the younger; (3) Richard Medcraft and William Cooke as trustees; John Gregory the elder assigned leasehold land in Schedule 1 to (3);
- letters of administration of 10 February 1834 reciting that Richard Medcraft survived William Cooke; that the leasehold land had become vested in (i)-(iv); that Richard Medcraft had no legal personal representative; letters of administration of the estates of Richard Medcraft as regards the leasehold land settled on him by John Gregory the elder were granted to (v);
- John Purrett, Sarah Welch and Elizabeth Potts agreed to sell at auction all freehold and leasehold land derived from John Gregory the elder at Green Man, Eversholt on 19 June 1833 at which James Smith purchased Lot 1 for £1,010 as well as all timber growing thereon since valued at £98 making a total purchase price of £1,108;
- (i)-(iii) apportioned the purchase monies for Lot 1 as follows: £749 for freehold and £359 for leasehold
Operative Part:
- (vi) paid £89/15/- [one quarter of the value of the leasehold property] each to (i)-(iii) being £89/15/- to John Welch as husband of Sarah Welch, £89/15/- to John Welch as husband of Sarah Welch who was personal representative of her late brother John Gregory; £89/15/- to (ii) and £89/15/- to (iv) with the agreement of (v);
- (v) paid 10/- to (iv) and (v);
- (v), by direction of (i)-(iii) assigned and (i)-(iii) assigned all leasehold land in both schedules to (vi)
Schedule 1:
(a) ground formerly described as a pightle in Berry End of 2 acres abutting: SE on common highway; SW on close formerly of Thomas Hillersdon afterwards Brewster and in possession of William Pratt called Little Field; on NE Maddle Croft Lane;
(b) ground formerly described as pightle of pasture of 1½ acres in Berry End abutting: N on Walls Green and on which a dovehouse was erected which remained standing;
(a)-(b) some time since laid together and then incorporated with a freehold close called Maddle Croft of Marle Croft and now called Dovehouse Close of 6 acres, 3 roods, 14 poles formerly in the occupation of John Gregory the elder, then John Gregory the younger, then James Potts late by Samuel Harris
Schedule 2:
(c) allotment of land at Higher Berry End consisting of two old inclosures called Upper Hays Gate and Lower Hays Gate formerly belonging to the Duke of Bedford and another old close called Walls Green which belonged to the trustees of the Town Estates and piece of ground formerly used as a lane altogether comprising 7 acres, 3 roods, 18 poles bounded: part E by Ridgmont Road; parts NW, E and N by old inclosure late of Dame Elizabeth Monoux; rest of sides by land in 1st Schedule;
(d) allotment of land at Higher Berry End comprising old inclosure called Woodcroft which belonged to John Gregory the grandson containing 4 acres, 3 roods, 25 poles exclusive of right of way for owners along Park Wall of Duke of Bedford bounded: NW and SW by old inclosures of Duke of Bedford; SE by old inclosure called Little Field; SE and NE by Barn Close;
(c)-(d) awarded to Mary Gregory at Inclosure of Eversholt
