    i) James Garth ii) Charles Garth Colleton, Haynes Hill, Wiltshire [sic] iii) William Ryder, Lincoln's Inn, Middlesex, gentleman said £6300 and interest not paid by i) Frances Colleton died on 15 March 1805, ii) then known as Charles Garth, esquire, Edward Hamilton Lambert, esquire (since deceased) and Thomas Ryder, esquire appointed executors by codicil to her will, dated 19 September 1802, Frances Colleton assigned all principal monies and interest due on mortgages from i), to ii) shortly after death of Frances Colleton ii) obtained permission by royal licence to use surname of Colleton, pursuant to will of Frances Colleton. there is now due to ii) - £6,300 and £212..12s..6d interest (total £6,512..12s..6d) now i) has agreed to sell property to ii) for £12,700 which, less above, amounts to £6.,187..7s..6d now in consideration of £6,512..12s..6d and £987..7s..6d paid to i) and £5,200 secured to be paid to him as hereafter mentioned i) and ii) release to iii) to hold to use of ii) … property as in X598/18-19 [2 farms in occupation of John Clarke and William Rogers] term: 1,000 years ii) to pay to i): £5,200 and interest at 5% signed: i) and ii) endorsed receipt witnesses: R Lowndes, J Bannell, Thomas Ryder, Thomas Carleton 6, 7 Oct 1808 also endorsed with: Merger of term on repayment of mortgage money a) Reverend Streynsham Derbyshire Myers, Mitcham, Surrey, clerk, and wife Elizabeth (Elizabeth being executrix of James Garth) b) Charles Garth Colleton £2,130 (part of said £5,200) and interest were not paid by b) to James Garth so interest of James Garth became absolute in law for remainder of said term interest paid up to 7 October 1807 James Garth died in February 1812. Will dated 14 February 1804. Will proved (Prerogative Court of Canterbury) on 26 March 1812. further interest has been paid to 7 April 1812, leaving £240 which being added to remaining principal sum = £3,440 now in consideration of said £3,440 paid to a) by b) a) yields up to b) … property as in main indenture, reversion and term of years to intent that term of 100 years may be merged and extinguished in the freehold and inheritance of said premises signed: a) witness: H D Lowndes receipt 8 Oct 1813
