    Recites: Agreement by Adam Bevan (on instructions of Martha Judkins) to purchase property from Edward Cope 29 September 1721, before 30 October. Martha Judkins died after 30 October, but before any conveyance had been made, leaving will dated 11 December 1721, devising all personal estate to Robert, John, Christopher and Martha Carter, children of her late kinswoman Anne Carter, and appointing Maxwell and Bevan (together with Emett, now deceased) executors. Edward Cope insisted on performance of the agreement for conveyance which was 9 May 1722 (NC1016) Robert, John , Christopher and Martha Carter alledged that they were entitled to the property conveyed, but the executors refused to convey it to them, holding that it was to be considered part of the real estate of Martha Judkins, which must pass to the heirs at law. The Carters brought a bill in Chancery against the executors and against Mary (wife of John Warner) and Anne (wife of Nathaniel Everitt), two of the heirs at law of Martha Judkins. Robert Carter alledged that as one of the heirs at law he was entitled to a moiety of the estate, but was prepared to waive his right if the petition of himself and his brothers to have the estate treated as personal property succeeded Chancery decreed that the property was to be considered as real estate, and that one moiety was to be conveyed to Robert Carter and the other to Warner and Everitt NOW i) convey to ii) :- Moiety of:- Steppington Close 100 acres arable, meadow and pasture Common for 7 cows and 7 breeders
