Trust monies in schedule to above release were not in fact paid or transferred to i) to vi) but were as a matter of convenience, transferred (as to mortgage for £13,500) to viii) and (as to £500 cash, £2000 Preference stock, and mortgage for £6000) to ix) in whom also, as executors of W H Rooper, there are vested the leasehold premises known as 'Chaddesley'.
reciting will of William Henry Rooper dated 15 June 1892 by which he appointed his son v) and his nephew, M G Rooper as executors.
Leaseholds bequeathed to executors to be sold. Proceeds etc for 5 daughters in equal shares as tenants in common. All real estate to son v). Will proved (London) on 2 September 1893. Residuary personal estate is mentioned in schedule 2.
v) recently purchased in his own name leasehold premises known as Pen Selwood in Bournemouth, for £4000, where his sisters are, with his permission, now living, and such premises have been assigned to v) accordingly
now i) to vi) confirm release to vii) made on 6 March 1894
ix) as executors of W H Rooper, shall, out of monies in schedule 2, repay to v) the purchase money of Pen Selwood
all monies in 1st and 2nd schedule shall be considered as forming one fund and belonging to i) to vi) in equal shares as tenants in common and shall be held in trust for them accordingly
