Reciting:
- Mortgage of 1 January 1884 from (iii) to (i) of land in Bedford, Saint Cuthbert to secure £13,000 and interest;
- Second mortgage of 24 October 1884 from (iii) to Charles Day of Easton on the Hill, gentleman, of premises in Bedford, Saint Cuthbert mortgaged on 1 January 1884 and not contracted to be sold, to secure £24,675/10/- and interest subject to the mortgage of 1 January 1884;
- will of Charles Day of 23 January 1884 appointing (ii) as joint executors;
- death of Charles Day on 21 April 1885 and proof of his will and codicil of 6 March 1985 in Peterborough DPR on 26 June 1885;
- (iii) had agreed to sell (a) to (iv);
- £13,000 was still owed to (i) together with some interest;
- it was agreed that purchase money from (a) would be used as a part payment on the mortgage of 1 January 1884
