  • Scope and Content
    1. Requisition on Title There being no words of limitation or the equivalent words 'in fee simple' in the conveyance of the 11th May 1896 of the land in the war but the conveyance being to "Hugh Cumberland" pure and simple the defect is radical as he only takes a Life Estate. The defect can only be cured by a fresh Conveyance from Hugh Cumberland's Vendors. Answers This is so. The Conveyance was prepared by the Vendor himself and a fresh deed will be procurred as desired. 2. Requisition on Title It is understood from Vendors solicitors that the Mortgagees N Sheaf and H Sheaf will reconvey to the vendor before completion. This must be done Vendors expense and the draft of the reconveyance should be sent to Purchasers solicitor for perusal previous to completion of such Reconveyance. Answers This will be done. 3 Requisition on Title Was George Charles Gostelow Lochhart married before the commencement of the Dower Act 1st January 1834. The present vendors Solution no doubt satisfied himself as to this on the Purchase by present Vendor from George Charles Gostelow Lochhart and that his widow would not become entitled to Dower. Answers He was married since 1834 4 Requisition on Title The Abstract of the Conveyance of 16th December 1878 (Edward Burr, R H Crabb and A E Burr to Frederick William Burr and Reginald Crab Burr) shows that Edward Burr and R H Crabb confirmed (but did nor convey) unto F W Burr & R H Crabb and A E Burr did nothing - Edward Burr & R H Crabb should have 'conveyed' & A E Burr have 'confirmed' to F W Burr & R C Burr not Crabb as in Abstract. Answers I cannot say as to this & by the terms of the agreement the purchaser is not entitled to make this requisition. 5 Requisition on Title Did the present Vendor on his purchase of the land at the rear have any evidence that it formed part of the property passing under the above Conveyance of 16th December 1878. Answers Yes he fully satisfied himself as to this. 6 Requisition on Title Is there any land tax or tithe or any change in the nature of either affecting the property contracted for or any portion of it. If so what is the amount of the annual Charges in these respects. Answers There is no tithe land tax or other charge on the property to the best of our information. 7 Requisition on Title Are there any rights of way water drainage ???? air or other easements affecting the property not disclosed by the Abstract. Answers Not that I am aware of. 8 Requisition on Title Have any Notices by any Local or Sanitary Authorities or by any adjoining or contiguous Owners affecting the property contracted for or any part thereof been served & which have not been complied with. Answers Not that I am aware of. 9 Requisition on Title The Purchaser reserves the right of making such further Requisitions as may arise out of the Answers or Non Answers to the above.
