- Scope and ContentRecites: Indenture 24 January 1703 (i) Right Honourable Thomas Earl of Ailesbury, said Lord Bruce his son and heir apparent (ii) Honourable Robert Bruce, James Bruce esquire, brother of said Earl (iii) William Longueville esquire declaring uses of common recoveries suffered of, inter alia, premises in Yorkshire of which premises herein after mentioned are part and by Mortgage 18 May 1723 i. Earl of Ailesbury ii. Charles Lord Bruce iii. Robert Bruce, James Bruce, brothers of said Earl iv. Right Honourable Henry Lord Carleton (since deceased) -manors of Fingall, Ellington and Newton Morker alias Newton in the Willow with appurtenances in Ellington, Maddaw, Ellingstring, Weld, Watlisse, Newton, High Newstead, Low Newstead, Rokewith, Hillgram, Heyming, Kuswick, Thornton, Steward, Hutton, Haw, East Marisforth, Thorn, Amgram, Coat Hammer and Sowden Beck in Yorkshire limited to iv. for 1,000 years subject to redemption, of £10,000 with interest at 5% per annum which sum was by iv. at request of i., ii. and iii. advanced for satisfying portion of Most Excellent Mary Princess of Hornes wife of Most Excellent Maximilian Prince of Hornes and daughter of i. Recites: Lease and Release 4 and 5 February 1705 Marriage Settlement [recited in RO27/1] Whereas: Marriage took place; Lady Ann since died leaving only son Robert Bruce and daughters Mary and Elizabeth Recites: Indenture 17 June 1720 (I) Charles Lord Bruce (II) Daniel Earl of Nottingham, William Peer Williams esquire (I) appoints £10,000 each to daughters Mary and Elizabeth for their portions, to be levied by trustees out of said premises whereas: said Mary has married Honourable Henry Brydges esquire commonly called Marquis of Carnarvon; her portion not yet paid and that of Elizabeth not yet due whereas: marriage intended between Robert Bruce son of Lord Bruce and ii) agreed that all premises of Thomas Earl of Ailesbury and Robert Bruce and James Bruce his brothers in trust for him and of Charles Lord Bruce in Yorkshire freed from charges, to be settled to uses by Lease and Release of same date as presents I. John Ivory Talbott, Francis Popham of Littlecott, Wiltshire esquire, Henry Hungerford of Fyfield, Wiltshire esquire VII. Honourable Dixie Windsor esquire, Sir William Thompson, knight agreed that 3 sums of £10,000 to be raised out of premises hereinafter mentioned in Bedfordshire and said premises to be vested in Charles Lord Bruce Recites: RO27/1 (Bedfordshire premises only) Now: i) appoint said premises after suffering of said common recovery, to enure to the following uses: to iii) for 1,000 years to use of Charles Lord Bruce iii) to raise by sale or mortgage of said Bedfordshire estates £10,000 for portion of said princess Mary of Hornes, already raised from Yorkshire premises by Indenture 18 May 1723 and raise said portions of £10,000 charged by said Indenture of 17 June 1720 for Mary Marchioness of Carnarvon and Elizabeth Bruce Witnesses: James Ralfe, John Lewis, T Adams, John Howell Copy attested by Joseph Wiles Burton and Christopher Haedy junior, clerks to Messrs Browne and Gotobed, 15 Norfolk Street, Strand
