- Scope and ContentThis Indenture made the third day of December one thousand eight hundred and ninety seven between Robert Luke Howard, Eliot Howard, Robert Samuel Lloyd and Henry Fox Howard, all of 90 & 92 Whitecross Street, Finsbury, in the county of London, Engineers and Brass Founders (hereinafter called the Mortgagors) of the one part and Francis Fox Tuckett of Frenchay in the county of Gloucester, Joseph Hoyland Fox of Wellington in the county of Somerset and David Howard of Devon House, Buckhurst Hill in the county of Essex. (hereinafter called the Mortgagees) of the other part. Whereas by an Indenture dated the twenty sixth day of November one thousand eight hundred and ninety seven and made between Robert Samuel Lloyd of the one part and the said Robert Luke Howard, Eliot Howard and Henry Fox Howard of the other part, the hereditaments hereinafter granted were assured unto and to the use of the Mortgagors their heirs and assigns as joint tenants. And whereas the Mortgagors have applied to the Mortgagees for the loan of one thousand pounds which the Mortgagees have agreed to make upon having the same with interest at the rate hereinafter mentioned secured in manner hereinafter appearing now this indenture witnesseth that in consideration of the sum of one thousand pounds at or before the execution of these presents to the Mortgagors paid by the Mortgagees out of moneys belonging to them on a joint account (the receipt of which said sum of one thousand pounds the Mortgagors do hereby acknowledge). The Mortgagors do and each of them doth hereby covenant with the Mortgagees that the Mortgagors their heirs executors or administrators will pay unto the Mortgagees their executors administrators or assigns the sum of one thousand pounds with interest for the same in the meantime at the rate of four pounds per cent per annum on the thirtieth day of June next and this indenture also witnesseth that for the consideration aforesaid the Mortgagors as beneficial owners do and each of them doth according to his estate and interest hereby grant unto the Mortgagees their heirs and assigns First - all that piece or parcel of ground situate in the township of Luton in the county of Bedford at a short distance from the Church cemetery containing by admeasurement 44 poles 4 yards more or less and extending in front abutting upon the road leading from Luton to Crawley Green one hundred feet and bounded at the back or southeast side by land formerly belonging to Frederick William Burr and Reginald Crabb but afterwards belonging to Hugh Cumberland and being the premises secondly hereinafter described and conveyed and measuring on that side one hundred feet nine inches and on the southwest side by a piece of ground messuage and premises formerly belonging to Ann Tirebuck but now belonging to the Trustees of the late Kitty Dines and measuring on that side one hundred and eighteen feet and on the northeast side by the Great Northern Railway late the Hertford Luton and Dunstable railway and measuring on that side one hundred and eighteen feet to be the same several dimensions respectively a little more or less and also all that messuage or tenement with the outbuildings thereto belonging sometime since erected and built upon the said piece or parcel of ground and which said messuage and buildings were formerly in the occupation of Messrs Hayward Tyler and others but afterwards of Hugh Cumberland and were formerly known or described as "Bell Vue" House but afterwards and now as "Brooklands" and now of the Mortgagors. And secondly all that plot or parcel of land now in the occupation of the Mortgagors and situate at the rear of and adjoining the premises first hereinafter described and conveyed and containing by admeasurement sixty four poles more or less bounded on or towards the north west side partly by the premises first hereinafter described and conveyed and partly by property belonging to the trustees of the late Kitty Dines and measuring on that side one hundred and fifty six feet 6 inches on or towards the northeast side by the Great Northern Railway and measuring on that side one hundred and nine feet on or towards the southeast by land belonging to Ernest William Hart and measuring on that side one hundred and fifty nine feet and on or towards the southwest partly by land belonging to Joseph Mardle and partly by land belonging to Miss Kate Tirebuck and measuring on that side one hundred and twelve feet to be the same several dimensions respectively a little more or less. To hold all the said premises hereby granted unto and to the use of the Mortgagees their heirs and assigns provided always that the Mortgagors their heirs executors administrators or assigns shall pay unto the Mortgagees their executors administrators or assigns the sum of one thousand pounds with interest for the same in the meantime at the rate of four pounds per cent per annum on the said thirtieth day of June next then they the Mortgagees or the survivors or survivor of them or the executors or administrators of such survivor their or his assigns will at any time thereafter upon the request and at the cost of the Mortgagors their heirs executors administrators or assigns reconvey the said premises unto the Mortgagors their heirs and assigns or as they or he shall direct And the Mortgagors do and each of them doth hereby Covenant with the Mortgagees that if the said sum of one thousand pounds or any part thereof shall remain unpaid after the said thirtieth day of June next they the Mortgagors their heirs executors or administrators will so long as the same shall remain unpaid pay to the Mortgagees their executors administrators or assigns interest for the said sum of one thousand pounds or for so much thereof as shall for the time being remain unpaid at the rate of four ponds per cent per annum by equal half-yearly payments on the thirty first day of December and the thirtieth day June and that they the Mortgagors will so long as ants money shall remain on the present security keep up all the said messuage and buildings insured against loss or damage by fire in the sum of one thousand pounds at the least and will pay all premiums and sums of money necessary for such purpose on the first day on which the same respectively ought to be paid and will on demand produce to the Mortgagees the Policy or Policies of such insurance and the receipt for every such payment and also that if default shall be made in keeping the said premises so insured it shall be lawful for the Motgagees to insure and keep insured the same in any sum not exceeding one thousand pounds and that the Mortgagors will on demand repay to the Mortgagees all moneys expended for any such purpose by them with interest thereon at the rate aforesaid from the time of the same respectively having been expended and that until such repayment the same shall be a charge upon the said premises hereinbefore granted the witness thereof the said thanks to these present have herewith set their hands and seals the day and year first above written.
