    Reciting death of Martha Fenn in September 1826 and mortgage of 24 October 1848 Henry Hankins Franklin (mortgagor) died on 25 October 1852 having appointed i) as executors under will dated 18 September 1852. Proved on 19 November 1852 Prerogative Court of Canterbury John Fenn being desirous of settling in the USA, about 5 year since gave up his interest in undermentioned property to his son, ii). John Fenn is now living in the USA and (if living) is 76 years of age. Mortgage sum of £100 is still owing ii) has sold property to iii) for £120 now in Consideration of £100 to i) i) assign and transfer, with consent of ii) to iii) - piece of land hereinafter firstly described, for residue of said term of 1000 years also in Consideration of £20 residue paid to ii) by iii) ii) releases to iii) 1stly - piece of land in Great Mead in Billington (2 acres 20 perches) late in occupation of William Fenn -piece of ground now used as garden ground on Little Billington Green (8 perches) now in occupation of William Garrett (said piece of ground was awarded at the enclosure to John and William Fenn in lieu of rights of common belonging to above piece of land) - small garden piece of ground at Great Billington (12 perches) now in occupation of William Garrett, which said garden was many years since taken in from the waste land there and fronting on orchard of John and William Fenn and lying between the same orchard and a private road to hold discharged from said mortgage security is declared, for the protection of iii) only from all mesne charges that the said mortgage debt shall be considered as being still on foot and unmerged Signatures of i) and ii) Endorsed receipts Witness William Allen, solicitor, Leighton Buzzard
