Scope and Content
Reciting will of Elizabeth Davies late of Great Brickhill, widow, dated 22 July 1839 by which she bequeathed all her moneys and personal estate to Jeremiah William Pettit and William Forsyth in trust for sale. After expenses and legacies paid, residue to be invested in Public Stocks. Interest to be held on trust to pay annuities during lives of Mary Fensom and Elizabeth Mitchell (who died during lifetime of testatrix) and to pay annual produce to Charles Pettit, senior, and wife Elizabeth, for life, and then for their children at 21 or marriage (for daughters).
Said Elizabeth Davies died in July 1859. Said Jeremiah William Pettit invested proceeds of personal estate in £2110 3% reduced Annuities, £3550 New 3% Annuities and £1539 9s 8d 3% Consolidated Bank Annuities
Charles Pettit and wife Elizabeth had 7 children i.e. William Fossey Pettit, James Pettit, said Charles and Henry Pettit, Edward Pettit, said E M Pettit and Mary Jane Pettit who have all attained 21 except M J Pettit who died on 6 May 1849 aged 5 years
Reciting also appointment of new trustees dated 14 April 1862 by which iii) were appointed in place of J W Pettit and W Forsyth Reciting also the will of Charles Pettit, senior, deceased, dated 22 October 1863 by which he bequeathed to his daughter, ii), £1700 to be paid within 12 months after his decease, Wife, Elizabeth, and iii) appointed executors. He died on 28 January 1864. Will proved (Northampton) on 29 September 1864
At Court for the Manor of Leighton Buzzard otherwise Grovebury on 29 and 30 October 1857 said Elizabeth Pettit and ii) were admitted tenants to
- cottage in North end of Leighton Buzzard with gateway and loft over the same etc with newly erected brick wall at Westward end of said garden commencing at end of 22 ft from corner of warehouse of Edward Hall, who had right of eavesdrop to part of said wall formerly in occupation of James Sanders, afterwards of Sarah Sanders and now occupied by Thomas Woodman as an inn called 'The Crown’
- 2 cottages adjoining last described now in occupation of widow
Roberts and John Hall, and farmyard adjoining now in occupation of William Aguttar and said Edward Fall
to be held, subject to life interest of Sarah Sanders in said cottage (she is since deceased), to Elizabeth Pettit for life and then to daughter
marriage is shortly to take place between i) and ii)
now ii) transfers to iii)
1/6th part of and in
- said sums of £2110 3% reduced Annuities, £5350 New 3% Annuities and £1539 9s 8d Consolidated Bank Annuities
- capital sum of £1000 part of said legacy of £1700, and interest also i) and ii) agree with iii) that after the marriage they will surrender into the hands of the Lady of the Manor of Leighton Buzzard otherwise Grovebury
- remainder expectant on death of Elizabeth Pettit in
- said cottages or dwelling houses
So that iii) may be admitted tenants
It is agreed that iii) shall invest said £1000 in purchase of public stocks. After death of ii) receipts payable to i) and then for children as ii) shall provide in will
Power given to pay out £300 to place out or put some son to a trade or profession. If she dies without children then to her heirs
Power given to trustees to sell estate if requested by ii) and to disenfranchise it
Trustees are given power, at request of ii), to convert assets into money for purchase of advowson or right of next presentation for the purpose of promoting i) to said benefice when it becomes void, i) to ensure his life in a sum equivalent to said purchase money
Power given to appoint new trustees
