    (I) Indenture of 30 September 1930 Parties: (i) T Thorne, formerly of Dunstable, but then of Ye Olde Angel Hotel, Henley; and B B Franklin of 35 King Street, Luton (ii) William Thomas Mead of Princes Street, Dunstable, builder Operative part: - (ii) paid £556.12.0. to (i) who conveyed (a) to (ii) Property: (a) Piece of land in Park Road South (formerly Houghton Road), Houghton Regis [now Poynters Road, Dunstable] as shown on plan, bounded on: NE by Park Road South with a frontage of 484 feet; SW partly by property formerly of Frank Charles Dawson but then of (ii) and partly by other property of (i), also measuring 484 feet; SE by other property formerly of Frank Charles Dawson but now of (ii) measuring 250 feet; NW by other property of F C Dawson also measuring 250 feet. Habendum: - (ii) to hold in fee simple Covenant: - (ii) to observe covenants and restrictions in schedule - (i) not bound to impose similar restrictions on their remaining property and could waive restrictions as they thought fit - (i) to produce copies of abstracted conveyance dated 24 December 1923 at request of (ii) Schedule: - (ii) to erect fence not less than 5 feet high along NW and SW sides of land as marked “T” on plan within 3 months. Not to use any paint or tar of black colour. - (ii) to observe building line as marked on plan and not to erect any building higher than 5 feet (except bay windows and porches) between building line and the road, and to erect similar fence on land fronting the road until land is built on - (ii) would not build any public house, beer house or other building selling intoxicating liquor, or permit a building to be used for such purpose or to carry on any obnoxious or offensive trade or business - (ii) not to build or permit any hut, shed, caravan, house on wheels or any other chattel to be used for sleeping, nor to erect any advertisement, hoarding, booth, show, swing or roundabout - (ii) not entitled to any right of light or air which would restrict the free use of any other land of (i)’s for building or other purposes. (II) Mortgage dated 17 September 1928 between (i) William Thomas Mead and (ii) Rural District Council of Luton reciting: - property with houses already built or intended to be built shown on Estate Plan marked A Operative part: - (i) covenants to build by 30 June 1929 at a cost of £850 per pair at least 26 houses built in accordance with specification in First Schedule - (ii) to advance £10400 mortgage to (i) by instalments subject to maximum advance per house of £400 and no advance to be made until Surveyor to (ii) certified in writing that the house had been completed to his satisfaction - (i) demised to (ii) property described in the Second Schedule and marked B on the Plan for term of 3000 years Covenants: - in event of failure to construct the 26 houses (i) would repay all advances under the mortgage with interest at 5½% - the sum of £10400 with interest to be repaid 6 months of the date of the final advance, or interest on outstanding sum to be paid quarterly. Proviso for repayment of the £10400 by instalments, with commitment to make repayments out of deposits and purchase money for the houses. In event of sale of house in respect of which (i) should not have received an advance from (ii), then (ii) to join in the conveyance without requiring any part of the purchase money to be paid to (ii) (houses numbered 13 to 22 on Estate Plan exempt from this clause). - (i) to keep the 26 houses and all other building in good repair First Schedule – type and dimensions of houses to be erected - houses to be brick and slated Parlour 3 bedroomed houses - ground area not less than 502 superficial feet per house - floor area not less than 871 superficial feet Second Schedule Two pieces of land in parish of Houghton Regis conveyed to (i) by conveyance dated 3 November 1927, with rights of way over Evelyn Road and other new roads or streets to be laid out: (a) 8 acres 2 roods 24 percehes on SW side of Houghton Road with frontage thereto of 730 feet bounded on: SE by property formerly of James Napier but then of (i); SW by intended new road to be known as Evelyn Road; NW by property of Thomas Thorne and Benjamin Belgrove Franklin (b) 4 acres 17 perches on north side of Luton Road with frontage thereto of 450 feet, bounded on: NE and E by Evelyn Road; W in part by property secondly described and part by property of Mrs Ada Caroline Jordan; NW by property of Edmund Hugh Woods (III) Further charge endorsed on (II) between (i) and (ii) as above. Reciting: - £9560 principal remaining due on security of (II) Operative part: - (ii) to lend (i) further sum of £10400 to enable him to construct further houses - to be advanced under same conditions as in (II) - valuation made on behalf of (ii) estimated that the value of each of the proposed houses would not exceed £1500 - (i) to construct before 31 December 1930 at cost of £850 per pair at least a further 26 houses as specified in First Schedule of (II) - maximum sum to be advanced by (ii) in respect of any one house is £400 - no advance to be made in respect of any house unless Surveyor to the Council has certified that house had been completed to his satisfaction - loan to be secured on property as in (II) in addition to sum of £9560 (IV) Mortgage dated 22nd January 1931 between (i) and (ii) as above, demising freehold property at Houghton Regis for 3000 as security for principal and interest owing on (II) and (III) [supplemental abstract missing] (V) Further charge between parties: (i) and (ii) as above Reciting: - (II), (III) and (IV) - principal sum of £15240 owed by (i) to (ii) on security of (II), (III) and (IV) - 3 further houses built on part of the property for which (i) requested (ii) to lend a further £1200 Operative part: - £1200 lent by (ii) to (i) at 5½% interest - proviso that principal can be repaid by half yearly instalments of £40 each - secured on all property comprised in (II) and (IV) in addition to outstanding £15240 (VI) Vacating receipt of 7 November 1944 by which (ii) acknowledged receipt from (i) of £3026 being balance of principal remaining under (II), (III), (IV) and (V). (VII) Memorandum dated 8 November 1844 endorsed on (II) in favour of Luton Building Society affecting 29, 61, 67, 87 and 91 Poynters Road, and 236 and 290 Luton Road, Dunstable.
