Reciting:
(I) will of Francis, 7th Duke of Bedford, of 7th May 1861 devising all his real estate to (i) and Thomas Henry, Baron Foley in trust for (ii) with power for (i) to sell
(II) death of Francis, 7th Duke of Bedford on 14th May 1861 and proof of his will and two codicils in PPR on 31st July 1861
(III) death of Thomas Henry, Baron Foley on 20th November 1869
(III) (i), with the consent of (ii), had agreed to sell (a) to (iii) for £10; (iii) then agreed to sub-sell to (iv) for £15
