    William Pestell of Campton, miller – the spade he now produces is his property. The last time he saw it was in his father-in-law’s kitchen last October. John Powers – he is the father-in-law of William Pestell. Yesterday morning about 11am he was going along a footpath in a field in the parish of Campton occupied by William West where he saw Heathfield digging a piece of ground. As soon as Heathfield saw him he caught up the spade and was going off. He [Powers] then left the field and entered it again at another corner. When Heathfield saw him again he took up the spade, left his work and was going out of the field. He said “stop Sam and let me look at that spade”. He looked and told Heathfield the spade belonged to Pestell. Heathfield said it did not. He knew the spade to be Pestell’s and that it was in his kitchen in the latter end of last October. Samuel Heathfield – “I found the spade in Mr Williamson’s plantation”.
