- Scope and ContentJohn Emery: he lived at Roxton and was a carpenter employed by Mr Metcalfe. An oak post with 3 mortices in it, the property of Mr Metcalfe was in his wood yard at Roxton from the 5 to 11 October. He saw it on the 5 October but on the 11 October it had gone. He saw it again in the yard that morning. Samuel Bond and Thomas Stearn were with him when he saw it. He didn’t know from his own knowledge how it came to be there. It was not fixed to anything and it was worth about a shilling. Thomas Stearn: he was bailiff to Charles James Metcalfe and on 26 October he saw an oak post forming part of the fence on the prisoner’s property in Roxton. The post produced was the same post. He knew it to be Mr Metcalfe’s post and had missed it from the wood yard some days before. It had not be sold or disposed of by Mr Metcalfe to his knowledge. He saw the same post that morning in Mr Metcalfe’s brewhouse. It was then taken out to the yard and he saw John Emery go and look at it. Statement of the accused: his fence was down and he built it up properly with his own wood.
