- Scope and ContentRecites Will of J. Wellingham of Whitwell, St. Pauls Walden, tanner, 2 Oct. 1802, bequeathing property to eldest son John the defendant ,subject to annuity of £40 to daughter Elizabeth (now dead) then wife of J. Nicholas, & to a legacy of £1000 to be divided among Elizabeth's children after her death and when they reach 21. J. Wellingham died April 1803 Elizabeth Nicholas died 16 May 1830 The Plaintiffs and also the defendant Sarah Nicholas (who is of unsound mind but with Lucid intervals) are children of Elizabeth Nicholas, over 21, and claim the £1000 legacy as a charge on the estate prior to the mortgage to Bacon.
