    Roll 46a Wylyton View of Frankpledge with Court of Lord John, Viscount Beaumond and Katherine Duchess of Norfolk, held there on Wednesday next before the feast of the apostles Simon and Jude in the xxxvjo [36th] year of the reign of king Henry Vlo [26th October 1457] Essoins John Noreys, lady Elizabeth Maryon, John Smyth, John Benet by the bailiff John Yarwey the younger) Randolph Bawdewyn John Yarwey the elder, John Fertyng [sic] John Taylour, ) constables John Redy Richard Wyneld Walter Yarwey Robert Taylour John Tyler’ John Salt John Norman Charged and sworn by various articles concerning the Court, they present that they gave vijs jxd [7s 9d] as common fine on this day. Amercement viijd [8d] And that the Prior of Newnham viijd [8d] owed suit and did not come. Therefore he is at mercy to the lord.etc. And that Robert Gostwyk has one ditch which is not draining, causing a nuisance, below his holding. Therefore he is ordered to put it right before the next Lete. And that the Lord required the tenants to repair the malt-kiln in the holding of John Stones. Amercement iiijd [4d] And that Thomas Shepherd iiijd [4d] assaulted John Waryn, against the peace, and struck him with a stick of no value. Therefore he is at the mercy of the lord. Amercement ijd [2d] And that John Salt lawfully raised the hue on the same Thomas Shepherd ijd [2d]. Therefore he is at mercy to the lord. Amercement vjd [6d] And that William Couper iiijd [4d] broke the hedges of John Tyler’ and carried them away. Therefore he is at the mercy of the lord. And that the same William ijd [2d] owed suit at this Court and did not come. Therefore he is at mercy of the lord. Amercement ijd [2d] And that Richard Wyneld ijd [2d] had timber to use in the repairs of his holding. And he has not used them as he was ordered. Therefore he was at the mercy of the lord and he was ordered to use them before the next under a penalty of half a mark [6s 8d]. And that Randolph Bawdewyn has ruined buildings and he was ordered to put them right before the next etc. And that William Launcelyn has kept back the xxs [20s] which he was paid for the making and repairing a malt-kiln in John Redy’s holding. Therefore a plea is with him. Order Also it was ordered by the lord and all the homage that the labourers by the day who are resident and belong to the Lete are not to accept labouring outside the vill. They are able to have sufficient services and payment within. Under a penalty of xld [40d] payable to the lord and the Church in equal portions, as and when they are found guilty to the contrary. Amercement xijd [12d] amercement xijd [12d] amercement iiijd [4d] John Cook, John Myton, tasters of ale, present that John Stoughton vjd [6d] brewed constantly and broke the assize of ale, Nicholas Waryn vjd [6d] constantly, John Redy ijd [2d] once, John Norman ijd [2d] once, John Flaunders ijd [2d] once, John Morborne ijd [2d] once, Nicholas Cruce ijd [2d] once, Thomas Sheperd ijd [2d] once, William Fesaunt ijd [2d] once, Thomas Brond ijd [2d] once, and they broke the assize of ale. Therefore they are amerced. Allowance of underwood The bailiff was ordered to deliver to John Yarwey the younger one rood of underwood to repair his stable so that he may make the Watelyng with corn. Also the bailiff was ordered to make an allowance of timber to John Yarwey the elder to repair his haybarn etc. John Norman and John Waryn were elected as Constables and took the oath. Taking To this Court came Nicholas Cruce and took from the Lord one messuage and x [10] acres of land and meadow, lately in the holding of John Redy, and another messuage and x [10] acres of land and meadow lately in the holding of Thomas Tele. To be held by himself, his wife and their sons for the terms of their lives and of whichever of them lives longest, rendering xxs [20s] a year therefrom to the lord and for service to be paid to the lord King, at the usual terms there. And the aforesaid Nicholas Cruce will well and competently repair and maintain all the buildings being in the said messuage at his own expense, except that the Lord will provide timber, withies and laths for them to make the repairs as and when they were [done] during the aforesaid terms and he owes suit [of court] twice a year. And he made fealty to the Lord etc. Amercement ijd And that William Couper ijd [2d] has one ditch not draining, causing a nuisance, next to his holding. Therefore he is amerced. And he was ordered to put it right before the next under a penalty of xijd [12d].
