    Joseph Matthews of Luton, labourer – on Wednesday 5 November about 11pm his master Peter Wilson of Luton asked him to see that his faggot stack was safe. He went to the stack close to Seven Acres near the Hitchin Road in Luton and found several faggots had been stolen. He watched the stack for about 5 minutes when he saw Kitchener and 2 others come to the stack. The other two helped Kitchener up and he began to throw the faggots off the stack. The other two took them up. Kitchener got off the stack and picked up one faggot which he was going to take away. Kitchener saw him, threw the faggot down and ran away. He caught him and took him into the Old English Gentleman and gave him in charge to the police. Nearly a hundred faggots were stolen from the stack that night. John Millard of Luton, police constable – Matthews desired him to take Kitchener into custody for stealing faggots from his master. As he was taking Kitchener to the cage he said he was very sorry he had taken the faggots and would take great care never to do so again.
