Transfer of Mortgage by Release
Parties:
(i) Thomas Smith of Crawley Green, Luton, gentleman;
(ii) John Green of Woburn, gentleman
Reciting:

- the principal and interest remained outstanding making a sum of £3,780

Memorandum: the £3,780 was the property of several persons in several proportions represented by John Green as follows: £1,200 belonged to Joseph Morris, esquire, Samuel Davis and John Green as trustees and was payable to them with interest at 4.5%; £1,912/15/6 belonged to Thomas Higgins and John Cole as trustees under the marriage settlement of James Warr and to which Warr was entitled during his life; £667/4/6 belonged to James Warr
- Deed poll by Thomas Beach Whitehurst late of Flitwick, now of Ampthill, clerk, Samuel Davis of Ampthill, gentleman, John Green, Thomas Higgins late of Woburn Sands, Wavendon [Buckinghamshire], now of Wootton [Northamptonshire], farmer and John Cole late of Aspley Guise, now of Bedford, gentleman. Reciting:
- £1,200 was the property of Joseph Morris, deceased, with Samuel Davis and John Green as trustees by a deed poll of 12th September 1833;
- £1,912/15/6 was the property of Thomas Higgins and John Cole as trustees in a settlement of 13th March 1834 between (1) James Warr and Mary Ann his wife and (2) Thomas Higgins and John Cole;
- £667/4/6 belonged to James Warr;
- Joseph Morris was dead;
- Thomas Beach Whitehurst had become the only person entitled to the £1,200 and had been paid;
- £1,912/15/6 had been paid to Thomas Higgins and John Cole;
- James Warr had requested Thomas Beach Whitehurst, Samuel Davis, John Green, Thomas Higgins and John Cole to execute a discharge for the sums paid;
- Operative Part: James Warr paid 10/- each to Thomas Beach Whitehurst, Samuel Davis, John Green, Thomas Higgins and John Cole who released all estates in mortgage to James Warr;
- witnessed by William Bartram, clerk to John Green; Francis Edmund Green of Bedford; Joseph Church of Wootton [Northamptonshire], master of the workhouse.
