    Indentures of lease and release and covenant to surrender between Edward Burch Field of Sidney Sussex College at the University of Cambridge and of Mount Sorrel (Leics) esq. of the first part , Isabella Hamilton of St Andrews Square in Edinburgh, spinster, of the second part and James Hamilton of St Andrews Square esq. (brother of Isabella Hamilton) and James Hastie Broad Street Buildings, London, gent. Recitals: that a marriage was intended to be solemnized between Edward Burch Field & Isabella Hamilton; that Edward Burch Field was seised in fee simple as eldest son and heir at law of his late mother Mary Field deceased in reversion immediately expectant in the decease of his father Edward Field [a marginal note records that Dr Edward Field died 10th May 1863 and was buried at Northfleet, Kent] who was entitled to the estate therein during his life as tenant by the courtesy of or to one undivided moiety and half part of and in the freehold lands and hereditaments (a – c) below; and his heirs according to the custom of the manor of Biggleswade of which the same hereditaments are held of or to the one undivided moiety or half part of the copyhold messuages, malthouse, lands and hereditaments with appurtenances described below; and that it had been agreed that the said one undivided moiety of and in the said freehold and copyhold lands should be sold and the monies produced by the sale thereof and the rents and profits in the meantime should be settled upon certain trusts for the benefit of Edward Burch Field and Isabella Hamilton and the issue of their intended marriage. Operative Part Conveyance from and Isabella Hamilton (in consideration of 10s paid to James Hamilton/James Hastie) to James Hamilton/James Hastie and their heirs of an undivided moiety and half part and share of and in : a) piece or parcel of arable land called Great Simon’s Piece containing 6 acres and 35 poles and lying on the east side of Potion’s Way and abutting on the commons of Biggleswade, and lately in the occupation of John Kirby Gold. (see Z 590/43 (k)also) b) piece or parcel of arable land in Biggleswade lying on the west side of Potion’s Way and abutting also on Biggleswade common and called Little Simon’s Piece containing 4 acres 3 roods and 10 poles and lately in the occupation of John Kirby Gold. c) Commons, commons of pasture etc. Habendum: with their appurtenances (subject to the estate therein of Edward Field) to James Hamilton/James Hastie their heirs and assigns and in fee in trust for Edward Burch Field his heirs and assigns in the meantime and until the said marriage should be solemnized and on the solemnisation thereof upon the trusts and to and for the intents and purposes expressed and declared of and regarding the same. Covenant and agreement (in pursuance and further relevance of the said agreement and in consideration of the said intended marriage) by Edward Burch Field and Isabella Hamilton with James Hamilton/James Hastie at the first or some subsequent court to be held for the mean of the solemnisation of the intended marriage to surrender into the hands of the Lord of the Manor of Biggleswade according to the custom of the manor of an undivided moiety or half part or share of Edward Burch Field in; d) farmyard and close of pasture as in Z 590/42 c) e) close of arable land called Rye Close as in Z 590/42 b) [sold and assigned to Biggleswade School Board according to a marginal note]. f) 13 acres of arable land as in Z 590/42 c) g) parcel of arable land in Town Field as in Z 590/42 d) h) parcel of arable land in Hitchmead as in Z 590/42 e) described here as 4 acres 1rood 30 poles i) parcel of arable land called Crain’s Piece in the town field, Biggleswade, as in Z 590/42 f). Habendum; to James Hamilton/James Hastie, their heirs and assigns or any purchaser of the same premises respectively (his or her heirs and assigns in such a manner as the trustee(s) acting as the executors of the trusts thereof should think most convenient for carrying on to execute the said trusts and for awarding the payment of any fines to the lord of the Manor other than such as must necessarily become payable to held of the Lords of the Manor of the rents and services therefore anciently due and of right accustomed; and that Edward Burch Field should until such surrender be made of the premises seised in trust for James Hamilton/James Hastie their heirs and assigns upon the trusts and for the purposes recited.
