    Charles Bone: he worked as a labourer for Mr Anstee of Lewsey. Around 17 or 18 January he had been at work by the stile on the Houghton footpath. Taverner came over the stile with coal in his pockets and before that he had gone to the coal by the straw rick and filled his pockets. They did not speak. William Squires: on 8 January he sent a ton of Hucknall Hand coal to the straw rick in Mr Anstee’s field, by the Houghton paths, for use in cutting up the straw. When they finished work they had left about 2 cwt there. On 9 February, he found it gone. PC Walter Gough: on 8 February he took out a search warrant to search Taverner’s house. He went to the house about 7pm and found a quantity of coal and a basket and hammer. He charged Taverner with stealing the coal. Tarverner said he had picked it up between the Halfway House and Skimpot Road. The coal had been taken from the stairhole and it was similar to that by the rick. Statement of the accused: nothing.
