    Recitals Memorandum of Conditional Surrender, 24 Dec 1840 (see Z 590/15). Making and execution of the will of William Larkins appointing John William Tebbutt of Biggleswade, stationer, and John Edwin Watts of Biggleswade, butcher, executors thereof, in which he devised to them all estates vested in him as mortgagee according to the natures and equities thereof, 9 Nov 1868 (abstracted in Z 590/31). Death of William Larkins (20 June 1870) and probate of his will with three codicils not affecting the premises at Northampton District Probate registry on 18 May 1871. Will of Henry Garner, 4 May 1854 (abstracted in Z 590/33). Death of Henry Garner (19 Dec 1857) and probate of his will (abstracted in Z 590/33). Will of Ann Garner, 30 Dec 1857 (abstracted in Z 590/33). Death of Ann Garner (17 Apr 1868) and probate of her will (16 Jan 1870) ( see Z 590/31). That the sum of £85 together with considerable arrears of interest still remains owing on the security of the conditional surrender first recited. That John William Tebbutt and John Edwin Watts have agreed with Nathaniel Garner of Langford, market gardener, for the sale to him of the said cottages or tenements and hereditaments with appurtenances and the inheritance thereof in possession according to the custom of the said manor, free from all encumbrances except the rents, fines, suits, and services therefore due and of right accustomed for £86. That it is intended that the purchase money shall be paid to John William Tebbutt and John Edwin Watts in full discharge of the principal money and interest owing on the security of the above mentioned conditional surrender and Elizabeth Norman has, upon the application of John William Tebbutt and John Edwin Watts, agreed to join in these presents and surrender the said cottages etc. to Nathaniel Garner as follows. Operative part Memorandum of Surrender Out of Court (in pursuance of the said agreement and in consideration of £86 paid to John William Tebbutt and John Edwin Watts by Nathaniel Garner with the privity and approbation of Elizabeth Norman) from Elizabeth Norman (she being a customary copyhold tenant of the manor acting at the request and by the direction of John William Tebbutt and John Edwin Watts), by the rod out of her hands into the hands of the Lord of the Manor by the hands and acceptance of Walter Roberts and William Thomas Chapman, gent., two other customary tenants of the manor, of... (a) cottage or tenement, yard, outbuildings and premises in Sun Street as in Z 590/31(a). (b) cottage or tenement and premises and appurtenances in Sun Street as in Z 590/31(b). ... to the use and behoof of Nathaniel Garner, his heirs and assigns for ever at the will of the Lord according to the custom of the manor freed and discharged from the recited conditional surrender of 24 Dec 1840 and the principal and interest expressed or intended to be secured thereby and from all claims and demands under or by virtue of the same.
