    Robert Whitworth: he lived at Brayfield. His brother, George had a farm at Turvey. In a field near the reformatory there was red wheat with a few white ears. On the Monday he went with Sergeant Busby to the prisoner’s house and they found some wheat of the same character as that grown by his brother. John Golding Howard: before 22 September he cut some wheat of George Whitworth’s of Turvey. He tied it twice with a manilla. The twine on the sheaf produced was manilla twine and the knot similar to the knot they tied with their machine. The knot was not hand tied. Reuben Sergeant: he had helped to shock a field of wheat which had been cut by Mr Howard with a machine. John Bolton had helped. They put 8 to 12 in a shock, which afterwards went to the wheat cart. He found one shock with 3 sheaves in it. There was no shock in the field with so small as 3 sheaves. James Busby: he found the wheat produced in the prisoner’s barn. Charles Harlow: he was present when Sergeant Busby searched the prisoner’s barn and found the sheaves. Statement of the accused: nothing to say.
