    Memorandum that Nathaniel Garner of Langford, gardener, a customary or copyhold tenant of the manor, in consideration of £20 paid to him on or before the passing of this Surrender by William Larkins of Biggleswade, gent., did Out of Court Surrender by the rod out of his hands into the hands of the lord of the manor by the hands and acceptance of William Thomas Chapman, gent., and Walter Roberts, 2 other customary or copyhold tenants of the said manor: (a) cottage or tenement etc. as in Z 590/19 and Z 590/22 to which Nathaniel Garner was admitted on surrender as in Z 590/22. ...to the use of William Larkins, his heirs and assigns for ever, at the will of the lord according to the custom of the manor under and subject, nevertheless, to the provisos, agreements and declarations expressed and declared of and concerning the same. Proviso for redemption upon repayment on 20 Oct next ensuing with interest after the rate of £5% per annum computed from the date of this surrender. Proviso, declaration and agreement that in the event of non-payment of the sum advanced and the interest on the day specified, it shall be lawful for William Larkins, his executors etc., absolutely to sell and dispose of the hereditaments and premises either by public auction or private contract and subject to any special or other condition, restriction or speculation with liberty to buy in and resell the same premises or any part of them and to vary the terms of or rescind any contract for sale and to surrender or otherwise assure the said hereditaments and premises to the use of the purchasers thereof, absolutely discharged from all equity or right of redemption and to give discharges or receipts for the monies to be received on such sale(s) which shall effectively discharge the person(s) paying the same from all liability in respect of the application thereof or of any irregularities in such sale(s). Proviso etc. that the produce of such sale(s) shall be applied in or towards the payment or discharge of the costs, charges and expenses of and incident to the execution of the trusts thereof and of the principal and interest monies which shall be owing upon this security and after satisfaction thereof any remaining surplus to be in trust for the person(s) who for the time being would have been entitled to redeem the said hereditaments and premises if the same had not been sold.
