George Brewer of Woburn, labourer – Patrick Flynn is a stranger to him. On Monday 3 March he was working in a field at Woburn belonging to Mr Downs by the side of the London Turnpike Road. He used the shovel and fork produced that day. When he left off work at 1pm he placed the shovel and fork in an outhouse in the same field about 100 yards from the road which leads from Woburn to Newport Pagnell. He did not go to the outhouse until Monday 10 March when he missed the shovel and fork. The next day he saw them in the possession of PC Pitson. George Facer of Woburn Sands in the parish of Wavendon, labourer – on 4 March about 11am he was at work on the Turnpike Road leading from Woburn to Newport. He saw the prisoner with the shovel and fork on his shoulder. The prisoner passed him and he spoke to him. The shovel and fork produced are the ones he saw the prisoner carrying. He was about ½ mile from Mr Downs’s field and the prisoner was coming in the direction from the field. Christopher Pitson, police constable stationed at Newport Pagnell – on Tuesday 4 March about 2.30pm he saw the prisoner in the town of Newport Pagnell carrying a shovel and fork on his shoulder. He saw him offer them for sale to several people. He stopped the prisoner and asked him where he came from and where he got the tools. The prisoner said he worked with them at Dunstable on Monday. He took the tools now produced. As he was examining them the prisoner walked away as fast as he could. He overtook him and took him into custody. The prisoner said he bought the tools. From inquiries made he ascertained that the tools belonged to a man named Brewer of Woburn and that they were stolen from a shed there. Patrick Flynn otherwise Grimes – “I did not steal them”.
