    Samuel Matthews of Sandy, labourer – he was at work for Samuel Fuller at Sandy on 17 August. About 10pm he rode a chestnut gelding belonging to his master to a meadow and left the horse there. On the same day Day was working for Mr Fuller. The horse was to remain in the field all Sunday and Day was to bring it up to Mr Fuller’s house on Monday morning between 4 and 5am. Day did not bring it so he went to the field and found the horse was gone. The previous day a bridle and whip belonging to Mr Fuller were hanging in the stable. On the Monday morning he found they were gone. About midday the horse was brought back in the care of Supt Smith who also had the bridle and whip. Henry Gibbs of Hitchin (Herts), police constable – he was on duty in the old Park Road at Hitchen on 19 August between 2 and 3am. He saw Day riding a chestnut horse. He spoke to Day and asked where he had bought it. Day said he bought it from Horncastle Fair. He asked Day where he was going to take it to. Day replied he was going to take it to London to his brother. He took Day into custody and removed him and the horse to the police station. [Cross-examined] Day did not tell him it belonged to Mr Fuller of Sandy. George Smith of Biggleswade, police superintendent – from information he received he went on 19 August to Hitchin with Mr Fuller. He went to the police station and found Day, the horse, the bridge and the whip. Mr Fuller identified them as his. He took the horse back to Mr Fuller’s the same day and returned the bridle and whip. He charged Day with stealing the horse from a field at Girtford on Sunday night. Day said “I cannot deny it. I was drunk or I should not have done it.” George Day – he has nothing to say.
