    Articles of agreement by way of marriage settlement Parties: (i) Marmaduke James of Aston [Hertfordshire], clerk and Sarah, his wife; (ii) John James of Petersfield [Hampshire], gentleman; William Hawes, citizen and mercer of London Reciting: - (i) had levied a fine sur conizance de droit come ceo etc. to John Hawes and William Thompson, gentlemen of six messuages, two gardens and two acres of pasture with appurtenances in Bedford, sometime the inheritance of Thomas Hawes, gentleman, father of Sarah and settled by him on (i); - before the fine, which was levied on sale of the premises, it was agreed that the £500 purchase money should be put out at interest in trust for (i); - the £500 was lent to Francis Beckett of Bedford, gentleman via two mortgages [R6/5/9/11 and one other not in this deed packet] Agreement: - Marmaduke James assigned the £500 to (ii) who would permit Marmaduke James for his life and then Sarah James for her life to take the interest, after both deaths the principal should be divided between the children; - Marmaduke James appointed (ii) as his attornies; - the £500 would be put out at interest by (ii) with the consent of Marmaduke James for his life, then Sarah James for her life; - (ii) should receive their costs from the interest or, if not sufficient, from the capital of the £500; - if any of (i)’s children married during (i)’s lifetime it was legal for (i) or the survivor of them to direct that that child’s share of the principal be given to them during (i)’s life or lives - witnessed by Elizabeth Baker, Francis Beckett and William Smedley Indorsed: “I do accept of the trust passed over to mee [sic] by the Articles within written according to the Uses therein expressed under my hand William Hawes” witnessed by Charity Hawes and Mary Hawes
