Scope and Content
Appoints wife Dame Harriet Payne and brother in law William Henry Wright, Lieutenant in Royal Navy, executors and trustees of will and guardians of the children during their minority.
To wife for life 14 Marine Parade, Hastings, Sussex and use but not ownership of household furniture, Plate, Linen, china and household effects, about the same house. On her death Power of Trustees to sell messuage and household furniture and effects but not the Plate. Money gained to go to his Personal Estate Account. To wife legacy of £500, horses, Carriages, saddlery, harness and stable furniture, wines, liquors, stores and household provisions. To wife till son Philip 21, household furniture etc at Wotton House. Wishes that family lives at Wotton until Philip 21.
To son Philip Monoux Payne legacy of £2000 at 21, and all household furniture etc at Wotton (subject to wife's use of it for life) + Plate at 14 Marine Parade, Hastings. To daughter Anna Maria Payne legacy of £200 when 21.
To Trustees: residue of real estate (including estates in West Indies) on trust to raise by mortgage to produce annual sum of £800, to invest same on Government or real security to maintain and educate her daughter Anna Maria residue to be invested at compound interest when 21 income, interest and dividends and from accumulations into Trust Fund for her use. (NB no power to anticipate same). Reversion to her children. Estate to be charged with difference between money raised by marriage settlement of 1852 and £1000 pa for testator's wife.
To son Philip:- all real and personal estate. Reversion to Anna Maria if he dies childless before he is 21. Ultimate Reversionaries William Henry Wright, Charlotte Elizabeth, wife of Herbert Leigh Esq and Anna Maria Wright (sisters and brothers of testator's wife.
To William Henry Wright all estates vested in testator as a Trustee or Mortgagee. Prepared by Blood & Son of Witham.
