On his return he went to the house of David Simpkins where his son Charles came and asked him if he had got any money because his brother William meant to have it. He went to his coffer and found the money gone. With David Simpkins and his son Charles he pursued the prisoner. They went to his house where they found he had just changed his clothes but had gone away. Police Constable Daniel Hazard, who took the prisoner the previous day (May 8) at Luton, produced 14 sovereigns and 2 half sovereigns, 9 shillings and 4 pence. He can positively swear to two of the sovereigns being part of those he put into his coffer. Charles Upton, wheelwright - he works for his father John Upton. When his father returned from the wood sale at Beadlow he went to a neighbour's, David Simpkins. His brother the prisoner came in and said he intended to rob their father. He went to Timpkins' and told his father. His father went home and found his money gone. Daniel Hazard, police constable - from information received he took William Upton into custody the previous day at the Rabbit Public House, Luton. When he produced the money John Upton immediately said he could swear to two of the sovereigns. On questioning John Upton's wife she said her son William came into the house the night of the robbery, said he wanted some money, took a candle and went upstairs, and when he came down said he had got the money. William Upton - "I never took any of his money and I am quite innocent of the job".
