    Reciting demise of 25 January 1792 by which property hereafter mentioned was assigned by (i) to Daniel Rudd for 1000 years. Also (i) covenanted to levy a fine of the property. Proviso for redemption on payment by James Bayley of £500 and interest on day long since past. Said payment not made. Said fine was levied in Hilary Term 32 George III. £100 (part of said £500) was paid by James Bayley to Daniel Rudd. Reciting that £6000 remains due to Walter Adams and £303 18s for interest and James Bayley is also indebted to Walter Adams in £315 on his promissory note dated 25 April 1802 and bearing interest at 5% per annum. Also James Bayley is indebted to Joseph Margetts Pierson, (iii) and Daniel Chapman of Hitchin, bankers and co-partners (Pierson, Wilshere & Company) in £391 14s 6d and interest at 5% per annum. On 30 March last said partners at request of James Bayley paid to Daniel Rudd £425 in discharge of principal and interest due to him and Daniel Rudd agreed to assign the property used as security to them. Also James Bayley is indebted to Richard Oakley of Great Offley, Hertfordshire, gentleman, in £250 on a primissory note, with interest at 5% per annum. Also James Bayley is indebted to John Crabbe in £548 17s on a promissory note dated 22 April 1800 for £500 and interest at 5% per annum. To better secure the repayment of the various sums, (i) appoint to (ii): -- messuage lately built on site where cottage formerly stood -- newly erected brewhouse etc at Padbury, Buckinghamshire, late in the occupation of James Bayley -- 1 acre land arable (1/2 acre) in East Field of Padbury in Over Gosland shooting into highway from Buckingham to Winslow and lying between lands of James Budd and Charles Dixon -- 1 acre land arable in East Field of Padbury adjoining Astock Field on Marborow Furlong: N Widow Swannell; S Thomas Merry late in the occupation of John Betts, to be held by (iii) on trusts subject to term of 1000 years and money secured thereby. Also James Bayley releases to (iii): -- messuage or farmhouse at Wroxhill, Marston Moretaine, and lands as above [see X 668/68] to hold to use of (iii) on trusts subject to term of 1000 years in security of 24 December 1800, to be held by (iii) in trust for sale. Monies arising to be held on trust: -- to pay Joseph Margetts Pierson & Co £425 by them paid to Daniel Rudd, and interest -- to pay £6303 18s to Walter Adams, and interest -- to pay costs of sale etc -- to raise and pay sums owing from James Bayley to Walter Adams, Messrs Pierson, Wilshere & Company, John Crabbe and Richard Oakley, and interest at 5% per annum -- to pay residue to James Bayley Until property sold, (iii) to pay interest out of rents and profits. Is agreed that (iii) shall not enforce payment of rent for that part of property occupied by James Bayley so long as he shall occupy same.
