He went out again about half past 8 and his shopkeeper came after him to tell him the window had been broken, he returned to find the window pane broken and found that the cream jug had been moved to the right hand side from the left hand side. Cornelius Sharpe: on the evening of 2 May he saw the prisoner and another man standing about 8 yards from Mr Kinnick's shop. The other man asked him if he could find him a place to lay down for the night. He said he would return at 9 o’clock and see. On returning he found them both standing close to Mr Kinnick’s window. The other man went with Sharpe, but Whelan stayed behind. On turning he saw Whelan break the glass with his hand. Whelan put his hand through the hole and picked up the jug. Sharpe grabbed him by the collar and he set down the jug. Whelan then attempted to get away. He was collared again. Whelan told him he wanted to be sent from the country and he had meant to steal one of the watches.
