- Scope and Contenti) Lady Madelina Fyshe Palmer, East Court, Berks, widow. ii) Ann Hornsby, Bedford, widow Thomas Gisborne, Horwich House, Derbyshire, esquire, and wife Susan Thomas Guy Gisborne, -- esquire iii) Thomas Wing, Gray’s Inn, Middlesex, gentleman iv) Frederick Henley Ongley, Old Warden v) Robert Henley Ongley, Lord Ongley vi) George Stone, Jermyn Street, St.Jame’s, Westminster, Middlesex, gentleman whereas: by release and assignment of 5 May 1832 between a) Charles Fyshe Palmer, Bedford, esquire b) John Heaviside, esquire c) Reverend James Linton, clerk, and John Linton, esquire, a major in His Majesty’s 6th Regiment of Dragoons d) Charles George Parker, Springfield Place, Essex, esquire e) Christopher Comyns Parker, Woodham Mortimer Place, Essex, esquire, the property was, in consideration of £5757 and £3243 (amounting to £9000) paid by d) in mortgage by a). Interest 4 %. Part of premises comprised in a term of 1000 years by indenture of 6 Apr 1821 made between Charles Fyshe Palmer and John Williamson were assigned to e) for residue of said term of 1000 years but upon trust for better securing to d) the payment of £9000 and interest and subject thereto upon trust for a) to attend inheritance : Charles Fyshe Palmer made will dated 4 Oct 1832 and bequeathed whole of property to wife i) who was also appointed sole executrix : by statutory release being also and indenture of assignment of 29 Sep 1842 between 1)d), 2)e), 3)a), and 4) Thomas Wing, the premises were, in consideration of £9000 to 1) paid by 3), conveyed to 3), and 2) assigned them to 4) for residue of term of 1000 years in trust for 3) : Charles Fyshe Palmer died on 24 Jan 1843 leaving said Ann Hornesby, Susan Gisborne and Thomas Guy Gisborne, his cousins and co-heirs at law and on 15 Feb will proved (PCC) : 1) has agreed with iv) for absolute sale to him of property subject to an annual fee farm rent of £9.17s.6d for £8000, and to intent that legal estate which descended to Ann Hornesby, Susan Gisborne and Thomas Guy Gisborne may be limited and assured to uses hereinafter created, they have agreed to concur in these presents and it is agreed that said term of 1000 years assigned to iii) shall be assigned by him to a trustee nominated by iv) now in consideration of £8000 to i) and 10s each to ii), ii) at request of i) have released to iv) - Park Wood (109 acres 2 roods) - farmhouse etc. (73 acres 3 roods 14 perches) formerly part of said wood in Old Warden and were late in occupation of Charles Fyshe Palmer and now in occupation of Jesse Masters - 2 cottages etc. in Old Warden now in occupations of -- Wheatley and -- Yorke [more particularly described in schedule] - all cottages, orchards, ground appertaining to iv) to uses, with limitation to v) during lifetime of iv) upon trust for iv). iv) expressly declared that if he should leave a widow such widow shall not be entitled to any dower of said messuages iii) on nomination of iv) and at request of i) assigns to vi) - such part of premises as are affected by term of 100 years. vi) will hold in trust for iv) to attend the inheritance with schedule giving details of fields etc. with note of separate examination of Susan Gisborne signatures i), ii), iii) endorsed receipt witnesses Aldred Twining Joseph Parker James Barker W.S.Gisborne John Nason
